Hey everybody...I need some advice..I am is citizen and was married to wife for ten yrs...while I was married my ex brother died in an accident overseas and she happened to filled family petition for him...long story short ...I went to her county and spent some time there after the passing of brother in law...during that time I got an affair with my brother in law’s wife and when everybody find out ..I ended up getting my divorce from ex...and after 14 months from my divorce we decided to get married in dec 2017...now my question is if I apply for her as spouse visa will there be any issues..that her ex is deceased and I married her and she was on that previous petition with the benificary as her deceased husband ...should I put there as previous applied before no or unknown...it will be an great help to shed some advice...

Timeline

The operative question is whether a petition was filed in her behalf.  If she intended to immigrate or the petitioner intended for her to have an immigration benefit resulting from the petition then a petition was filed in her behalf.  

 

The circumstances of your meeting, affair, divorce, and marriage will be highly scrutinized.
