Changed my mind about withdrawing I-130 petition for my husband

Hello all,

I need help please

I applied for my husband I-130 in February last year. All documents were submitted and the USCIS approved the petition and sent it to the NVC around October( NVC started processing after fees were paid but no interview date was scheduled yet), my husband works overseas but came to spend the holiday with me, we had serious marital issues in November around thanksgiving, I told him we were done, he decided to sleep out of the house and date another until he returned to his country in December, at which point i sent a letter to the NVC and our lawyer at the time to withdraw my application. NVC sent a notice stating they had received my request and sent all of my documents back to the USCIS for review. I have worked things out with my husband and I no longer wish to withdraw my petition. Since I didn't send a letter to the USCIS also to withdraw, can I just call them and ask them to return the documents to NVC or do we have to start the process all over again? someone at the USCIS once told me that if I didn't write to them within 180 days ( time of review) since the application was already approved they will return it to the NVC to resume and we will probably have to pay fees again. Is this information correct? can we just start back where we left off?

Sorry there isn’t any taking back a withdrawal, if you got the opposite from USCIS phone line talking to the first person who answered rather than transfers you to another then you have encountered the misinformation line. It’s famous on here for giving out false info.

Once a withdrawal is in motion, there is no stopping it/taking it back.

You will have to start from Square One all over again.

As stated, a withdrawal itself cannot be withdrawn.
