I filed single but married

Helppp! So, I got married MARCH 2015 but then when I filed my taxes for 2015 I put Single because I was recently married then. And I haven't change my status on SSN as married that time. Now, I have to submit taxes form to NVC to petition my husband. I claimed married filing separately the following year. What do i do? Will there any red flags?

You at any time can amend your previous tax filing for 2015.  This link should help.

You married March 2015, then filed for 2014 taxes(filed in 2015) or the next year you filed for 2015(in 2016)?

 

If you filed for 2015 taxes in 2016 then you can amend them.

 

If you filed in 2015 for 2014 years taxes, no need to do anything, you were single during that year.

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Friends don't always give out the best advice.  No idea why that person thought location would make a difference in terms of one's legal marital status...For future reference, you're still married no matter what country you both reside in separately at the time.

 

You should get your taxes amended.  The tax info is not just about financial support/sponsor info....They will want to see evidence of a bonafide marriage since March 2015---taxes (whether married filing jointly, or married filing separately) is a piece of that.

Yup bad advice from them.

 

I would amend the taxes, not just for this, but so that your taxes are in order and correct.

For the I-864, you only have to submit one tax return...the latest you have filed, either 2016 or 2017 if you've already filed it.

Just a note on this if you want to amend you may wish to do it soon on your oldest filing.

 

In 2013 I tried to amend my 2009 taxes from Head of Household to Married filing joint (divorce issue and ex refused to joint file until well past divorce).

 

IRS rejected it citing "No amended changes of status more than three years from filing date"

Made an appointment at the local IRS office and was told same thing, too late. 

 

Had to leave it as HoH so lost out on $2100 of refund

I filed married filing separately last year. Im going to do the same thing this year. I'd probably get more return if I try to get ITIN for my husband. But I don't want them looking at my 2015 return since I made a mistake claiming "single" then.

My wife arrived in June of 2015.  I just filed an extension that year which gave me until October to file.  We got her SS number and filed joint in August.  Always an option, easier if you're expecting a refund as you still have to pay estimate if you owe.

I don't owe anything. Probably get more refund if I do that. Totally, different question: Can I go abroad for 2 months while waiting for NVC to prcess things?

No reason why you couldn't.  I was in and out of PI 4 times between our filing date and visa issue
