Background info:  My husband came here on a K1 visa.  We applied for his EAD and AOS on 2017-09-25.  We received an RFE for Initial Evidence 2018-01-10.  They claimed that I did not prove to be over the 125% poverty line (though I am, and provided tax forms, letters from employers, pay stubs, etc.).  I resent all this evidence, as well as added a joint sponsor just to be extra careful.

 

I'm certain we've done absolutely everything we need to do; I'm also certain that I am over the 125% poverty line (not by too much, but still over the mark).  Our congressman has been inquiring for us; we added the joint sponsor; we've stuck to this long process for what seems like forever.  But I still have this awful weight on my chest that we will get denied, even though we meet every qualification.  As I write this I guess I'm looking for sympathy and a kind word more than anything (life will be so much easier once my husband is able to work and money is less tight), but I'm out of ideas.  Is there anything I can do at this point except wait?  Any words of advice?

Sorry to hear that. I completely understand you because I am in a similar situation.

that sucks, i am sorry to hear. why do they take so long to send an rfie? since its for an initial evidence i would thought that they'll send those closely after receiving your application. letting you wait more than 3 months (when others have received their ead/ap already) and then only to send you an rfie that may reset your clock to 0 is just mean and inefficient!

I'm sorry to hear that.  We got an RFE once during our removal of conditions.  It sucks.  I think you re-sent everything you could and more.  All you can do is just wait now.  Just know: none of this process will be very logical or efficient.  Just roll with it, be patient and try to distract yourself with other things because it can be very consuming.

Thank you for your understanding!  I can get to answer as to why the wait was so long.  Each time we call, we hear that they are processing a different time.  August, December, whatever.  The only reason they pulled our case out at all is because my congressman got involved and requested an update.  I don't understand how the process can be so illogical when millions of dollars in poured into it every year.

Thank you for your encouragement.  This is our first RFE; I've been organized, and it's frustrating for that not to pay off.  I'll do my best to take your advice :)

Did you send official tax transcripts ? At least 6 pay stubs ?

Did the employer letter include everything needed ?

When something was missing in supporting evidence , for example W2's or not enough pay stubs the RFE will always say the income doesn't meet the 125% guideline

even so it does so maybe you forgot something.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

So sorry to hear that! Maybe your EAD expedition request was approved and they were working on your EAD application, during which they have to check whether your AOS was properly filed. At least that is something. The tree has been shaken.
