Hi there,

 

My partner applied for a K1 visa back in July 2017 so we are hoping to hear from USCIS soon. He's from Australia and we are wondering what police checks he needs to get? He lived in the U.S. under a student visa from August 2014 - July 2015 but our immigration lawyer seems to think he doesn't need a US police check (which didn't sound right to us). Any advice?

 

And for the Australian police check, are we just doing the one where you submit your info and they run your name through and mail you a certificate? No fingerprints?

No US police check is needed.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You really shouldnt listen to that lawyer.... I hope you are not paying him/her a lot. He will need a police check from Australia. 

I had to provide a police check from every country I had lived in.

This clearly says that a police check from the US is NOT needed....

The attorney said a US police check is not needed....and he/she is correct.

We know that he needs an Australian check - I am asking about whether he needs the US check

You don’t need a police certificate or clearance, or anything along those lines from the US because USCIS conducts a full background check on you before approving your case. You only need certificates from other countries.
