Hi All, 

 

I am in the process for filing the i-130 for my husband who lives abroad. One question I am stuck on is if a petition was filed for the beneficiary prior? I did apply or the K1 visa for him and after being put on AP for very long we decided to withdraw and get married in his country and then apply for the Spouse Visa. My question, would I put yes or no for this question since it does not explicitly say for any visa or the spouse visa? Additionally, can people who have applied share the types of evidence they provided with their i-130, it is a little different than what was asked of us for the K1.

Have you EVER previously filed a petition for this
beneficiary or any other alien?
1.Yes/No
If you answered "Yes," provide the name, place, date of filing,
and the result.

your answer will be yes, you have filed one, write his name in the space and explain what the outcome was, did you pull the petition back?

my question is if you gotten the K1 starting over with a CR1 will take another 12-14 months to complete

If you'll look at the I-129F you filed, you will see it is a "petition" not a visa application.  Yes, YOU filed a petition for this beneficiary.

I meant to ask why they would start the process over, it will not take longer for them to be together. had they stuck out the K1, they would have been potential together sooner.

yes we withdrew, got married, reapplying now for the spouse visa.

because we wanted to get married, regardless not really the point, we already moved forward, i am just seeking some guidance.

In our case,weAlSo had a previous denied K1. 

1.Yes 

My husband wrote down my name(maiden name)place of filing:Moreno Valley California

Date of filing was the date they received our petition

And the result: I-129f approved,K1 visa denied.

do you mind if I ask you, if in their reason for denial is it not something that could have been appealed? 

 

I guess I am clueless and never should have responded to the question before, as I didn't know that a denial could happen I just assume they would ask for more evidence.

K1 visa have a short validity period of 4months.. After your interview,the co allows it to expire before sending it back to the U.S. where you will be told to either refile a K1 or come over to the beneficiary's  country to marry him/her&start the CR1 route

Place of filing would be the service center, or even "Dallas, TX" where all I-129F petitions have been mailed the last few years would be the correct answer but it is not critical.

I see that it is a question of personal curiosity.  Bear in mind that the quickest way to be together is not ALWAYS the highest priority for some couples.
