Blame lies with those Filipinos who abused the B2 in the past. Creates a higher bar for those who follow.

Why not have your surgery in the Philippines?

 

As others said taking care of you while you recover is considered work, you (she) applied for a tourist visa, not a work visa. It is very hard for a Filipino to get a tourist visa in the first place. You need strong ties like assets money in the bank, etc. Even if she mentioned her kids it would not have helped. Thousands of mothers leave their children to go work abroad every month and have a family member raise them.

 

I understand you are not happy with the result but rules are rules.

Surgery can’t be done here. The Philippines does not have the facilities nor the expertise to do it - one procedure is abdominal wall reconstruction which requires expertise not available here. 

 

And there is a difference between carrying for. an individual for pay and caring for an individual because you love  them... I can hire a nurse, can’t a partner. 

 

Rules are rules - true. But all too often it’s the ones who play by the rules that get the short end of the stick.

Unfortunately not all previous B2ers have played by the rules.. overstaying, AOSing etc. Some of those who follow pay the price. Is it fair? No

I understand.  You would think, though, that the process would at least allow for extended dialog to at least get a clearer picture rather than making such decisions on an interview less than 2 minutes long. For special request anyway... but, I guess that would open pandora’s box at the embassy.

 

At least take an additional two minutes to hear from the sponsor to vouch for the individual or clear up any language barrier miscommunications.....something of that nature. Just a cold hard and fast disapproved.....with zero recourse. Tough

If it were me, I would have a separate application process which provides extenuting circumstances for a select group of categories and allow the embassy to decide, based upon information provided in the application,

whether or not to entertain a special request. Sort of like how high courts determine which cases to hear or not. 

 

Sure it will increase workload, but this isn’t about workload, it’s about real people with real

situations that require a little more than the basic you don’t have a stable job, you have no money and own now property - denied.

Tourist visas don’t have sponsors.

Plenty of jobless, non-moneyed, property-less applicants get visas. They document other ties to home.

In the vast majority of cases the interview is a formality, the application provides the details needed.

 

There is no sponsor.

I get what you are saying but not in the eyes of the government. If she is not there to take care of you and assist with your recovery you would need to hire outpatient services for that. That's takes a job from an American. Not trying to upset you, just pointing out the reality.

I will agree with all of the ones here that have said it was the bad apples that spoiled it for everyone. My wife is in the Philippines. I would love for her to be here with me. It would hurt no one if she was here with me, being supported by me while we finish the visa process. We both knew this going in and it sucks. But like I said rules are rules and the scammers made hard for all of us legitimate people.

All over.. post was in reference to OP's desire for a separate process for select applicants. 

Done plenty of research, thank you very much. Never would I suggest generic jobless Filipinos being approved for a b2.
