Untrue. Several people have been successful in mandamus actions with regards to immigration matters.

Writ of mandamus as others have said, and it's not a DIY thing and supposedly costs a bit. 

 

I know it's small potatoes but you will skip ROC thanks to this delay so one less thing to mess with immigration wise in the long run.

Yes, we were able to skip ROC after a very long pending AOS and it was definitely worth waiting 2 1/2 years to get approved to not having to pay hundreds more and filling out forms and waiting again for ROC. Glad you brought it up, I forgot to mention it.

Applicants may submit Form I-131 and request expedited processing. Additionally, applicants may request an emergency Advance Parole document at their local USCIS field office, however, this should only been done in extremely urgent situations.

When visiting a local office to request emergency advance parole, you should bring the following items:

•A completed and signed Form I-131, Application for Travel Document

•The correct I-131 filing fee

•Evidence to support the emergency request (e.g. medical documentation, death certificate)

•Two passport-style photos.

Are you going to another state or Nigeria ? That was not clear from your post, you said "travel out of state".
You can make an infopass for travel emergency.

$575.  Fee is waived if only filed at the same time as the I-485

I've read that sometimes applying for emergency AP requires you to pay the I-131 fee, regardless of it usually being waived under an I-485. You should be prepared for that eventuality.
