Got Interview Scheduled: Pregnancy + Short Time ?

Hi, 

I understand this question may be a bit random,  but I've found your blog to be very helpful, and figured you might have an idea for a unique case of mine.

 

My wife's interview date for her CR 1 visa is on January 29th, assuming it'll be approved and visa granted by February 6th, and the baby is due on April 29th (3 months after). We're looking to come back to Bosnia for birth of the baby as it'd save us $10,000.   

 

Now, I've found that the green card is usually sent ~1 month after arrival, which should be first week of March, making it difficult for us to travel.

 

I also understand that if we stay, we'd have to leave (with the baby) by ~August 6th. 

 

Do you have any recommendations on what we could do ?  Go to the US, and return to Bosnia, or wait in Bosnia, and after she gives birth travel with her temporary visa. 

 

If it helps, the address I have on file for my wife's green card is a virtual post mailbox which could easily Fedex me her green card to Bosnia

 

I highly appreciate it.

It's a non-issue.

 

Either she travels with the visa, pregnant, leaves with you and goes to Bosnia and has the baby and returns using the endorsement in her passport which acts as an I-551 (green card). She doesn't need the physical green card to re-enter. 

 

Or she waits until after the baby is born before she enters the USA for the first time with the visa. The visa is valid for 6 months after the medical date. Provided she lands before the expiration date of the visa, she's fine. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Thanks -- doesn't the I-551 have a one-time-only use ?

Nope. The CR-1 is valid for one entry only but the I-551 is the same as a green card. Valid for a year and she can come and go as she pleases.

Thank you for your concern -- I highly doubt she could fly 1-1.5 months before pregnancy from what I've seen. 

 

Would appreciate any other suggestions you folks might have.

No, Her passport will be stamped at the POE.

I see. I entirely misunderstood then. Apologies. 

 

In that case, she can technically fly out of the US after she's entered, more-less? 

 

In other words -- that passport is valid for multiple entries and there are no restrictions apart from the fact that it's valid for 6 months, until the green card arrives ?

You are making a BIG assumption---that the birth will be a completely average delivery. If she ends up need ing a C-section (US doctors will not take any risks), or the baby needs anything extra, the price difference could be $25,000 or more.

correct me if I'm wrong, but, if the deductible is $X and there is no co-pay, then the cost to me is $X, whether it's a $5k, $10k, or $40k delivery
