If you can't show hard proof for the 5 year requirements, prepare to file I-130 for your child (to get a green card). At least he/she will receive automatic USC once you travel to the US with him/her.

This a thread of 2013. Can we file i-130 immediately without placing the crba denial letter on it?

Without you providing any background info (who is the USC, how old is the child, did the USC every live in the US etc.) I fear I do not understand your question.

It's amazing how many questions can be resolved with a 2 minute Google search...

Sorry. My husband is a usc. I am a filipina. Our firstborn is 4 months old. My husband's physical presence didn't meet crba requirement since he mostly lived in other country.

I that case after your denial, file the I-130 for the child and you. Make sure to include a cover letter explaining why he is filing for his child, eventhough he is a USC. Just including the denial letter might lead to confusion.

It's amazing how many questions can be resolved with a 2 minute Google search...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
