Hello everybody,

I am new to this forum, but I've been reading about the K1 visa for a while now, I've read all the FAQs here and the instructions and me and my girlfriend feel confident to start the application ourselves.

 

There's only one part of this process that is still a bit confusing for us. Allow me to explain.

 

I am from Brazil, and my girlfriend is American. We want to start the K1 visa now in order to get everything ready for me to move to the US in August 2018.

In July, i will graduate as an Engineer here in Brazil and my girlfriend is also finishing her studies in the US, so none of us have a steady job with a fixed income enough to fill the Affidavit of Support. But my girlfriend's father is OK with being our sponsor, and so is my father (They both have enough income to meet all the requirements, but my father is from Brazil and i don't know if that would be a problem)

 

My question is, how does the sponsor and co-sponsor situation would work?

My girlfriend would be my sponsor, and her father would be her co-sponsor? or my co-sponsor? 

Should my father be a co-sponsor as well?

Only a USC or LPR can be a sponsor.  So her father can be the co-sponsor for the I-134 and the joint sponsor on the I-864. Make sure you have read through the whole process including the adjustment of status for a K1.  The K1 journey is only half of the journey to green card.

The petitioner is always the primary sponsor. They are who the government would sue first if the beneficiary uses means tested benefits.

Don't plan on moving until the process is complete and you have visa in hand / you can  not count on the move happening next August / it is taking a lot longer these days for completion of all applications including K1

I'm not going to move until I have received the K1 visa, but by looking at the timelines and processing times, I thought that July/August would be a realistic scenario.

We are using co-sponsor because of a similar situation, and all the above is correct. She will be your first sponsor and father the co-sponsor for you. 

 

About timeline: 

 

If you get no rfe and No AP and luckily everything goes perfectly smooth and your embassy is fast (Brazil was pretty smooth if I remember correctly already two may filers finished he interview!) and who knows maybe their processing times improves.. yes it is realistic.

 

if things get worse, you get an rfe, or something, anything happens (like them accidentally sending documents somewhere else) 

 

i believe it is realistic for august, and I understand you won't go there unless you have visa :) 

 

just dont buy the tickets till visa on hand and try to make adjustable plans for wedding if you guys are going to do one.

(I'm a September filer aiming for July 28 wedding. When I started I though I was going to have visa on hand by February)
