I need help

my interview next week and my spouse is my sponsor but she had some issues with her work that got her terminated letter in this week and she use her income to sponsor me and her income is enough.

my question is  will that be aproblem for my case

and if it will be she have assests meet the requirements .will assests without income will be enough?

Sorry to hear that.

Unfortunately, it will be a problem and I would highly suggest not hiding this from the interviewer.

Her and/or your asset has to be three times the amount listed in I-864P for your household size.  Only assets that can be converted into cash within one year will count. See page 8 part 7: https://www.uscis.gov/sites/default/files/files/form/i-864instr.pdf

Alternatively, you will need to get a joint sponsor. See forum below:

I'm not sure, I think you're fine with not disclosing it when not asked.

Your interview notice will most likely tell you to bring recent paystubs and a letter from your employer. They never asked for those things in our interview, but we had them as instructed. They did ask me if I was still working there, and many people report being asked something similar.

You need to be prepared to show you can meet the 125% guideline at the time of your interview. I don't know if they count unemployment payments, but I would guess they do.

If I were you, I'd find out for sure and be prepared to show evidence of the unemployment payments. No one wants their approval hung up after the interview on an RFE. If your unemployment won't work, line up a co-sponsor and go in with the appropriate I-864 completed and ready to go.

Edit: Sorry about losing your job. That sucks.

Also, I don't think USCIS is going to contact you because you started receiving unemployment. If they are going to ask, it will be at the interview.

Yes, you will need to show proof you have your asset for at least the past year.

In the sense that it is basically material misrepresentation, then sure if you are into that kind of thing.

OP, you are going to need to provide the embassy with an updated I-864 with correct information.

The answer depends on whether you are specifically asked about your wife's current employment.  If your are not, and she qualified as sponsor on the date the affidavit of support was signed, losing her job is a non-issue.  If asked though, you must answer truthfully.  If she disclosed and documented enough assets to qualify, then you would still be OK.  If she has the assets and didn't disclose them, I would get an updated affidavit of support disclosing and documenting sufficient liquid assets and carry it to the interview in case it's needed.  No need to volunteer it if the subject is brought up by the interviewing officer.

A Warning to Green Card Holders About Voting

I think that not giving an updated I-864 if your spouse’s income changes comes very close to misrepresentation. The law says that your US spouse must meet the financial requirements for their household size to sponsor a foreign spouse or get a joint sponsor. If your spouse just got terminated, she no longer has a salary and hence cannot meet the financial requirements.

Also, one of the main questions they seem to ask at the interview is “what does your spouse do for a living”.... My suggestion is to bring a new I-864 supplemented with either assets or a joint sponsor.

Thank you all for help . I think because there is no time to get updated form i will go to the interview and if they need  updated form  then  We will do one and send it to the embassy later  after the interview .

And submit it if the subject comes up. ^_^  Or, since there isn't time, submit it, if needed, after the interview.  There would only be misrepresentation if the applicant lies.  The submitted affidavit was true and correct when signed under penalty of perjury.  Any suggestion that absent a specific question in the interview and/or request for an updated affidavit, that there has been any misrepresentation, is an incorrect "inference" in my not so humble opinion.
