Can anyone help me?

i got married from a USC. We have a twi month old little one. We never applied her to crba since we are lacking of some proofs(on my behalf) . So we opt to apply CR-1 . Will my petitioner file separate application for me and our daughter?

Your daughter is a USC , you  will NEED to complete CRBA, embassy will not complete the visa process until that is addressed.  

 

For you , yes he will file the I-130  https://www.uscis.gov/i-130      https://travel.state.gov/content/visas/en/immigrate/immigrant-process/petition.html

Apparently, we don't have photos together during my 3rd month growing tummy. He left when I'm two weeks pregnant

You need proof you were together at the time of conception not at 3 months. I believe that if you don't have enough proof they will make you take a DNA test. Not 100% sure how that all works.

You aren't the first to be separated during pregnancy.  Did they deny CRBA?

Being you are married, if your husband wants to bring you to the USA .. yes you much complete the I-130 IR/CR-1 process.   This has NOTHING to do with your daughter.. she is a USC.   For your daughter you can NOT file for a visa .. she is a USC.  

 

Need to complete CRBA!

I think you are very confused on how this all works. First off you and your baby are 2 separate issues.

 

You will need a visa to come to America. Since you are married you will need a CR-1.

 

Your child is a US citizen by birth but you must file for CRBA. Once that is complete your child will have a US passport and citizenship and will not need a visa to enter US.

 

You said you don't have proof for CRBA. I am sure you do have proof. Did you not take any pictures together when he was there when you became pregnant? Did you stay at a hotel at all during his stay there and have receipts, email confirmation, etc.? He should have flight information, boarding passes, itinerary, as well as stamps on his passport showing that he was there when you became pregnant.

 

Just understand that you and your child will follow different processes to enter the US.

To clarify,, so you applied for CRBA, went to the embassy with the baby  for the interview, and they denied you, with their stated reason being you do not have photos of you and your USC husband while you were pregnant? And the baby is biologically yours and the USC husband's?   Or do you just THINK that will happen?  I have never heard of a denial on those grounds, and since baby is only two months old, it seems unlikely you even got an interview yet.

 

 

If they did deny you, did you get any papers stating so?  Did they offer to re-consider with a DNA test?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

How was that? I have almost the same status as my friend. Because she has a husband who is a citizen by naturalization. They are lacking of 4 months to complete his physical presence which is 5 years. Is there any possible way to solve it

If you want help or advice please take the advice and help being offered. Otherwise I see no reason for your post. You have almost the same status as your friend so you are basing your thoughts on what someone else is saying? Did you stop to think maybe your friend does not completely understand, or maybe you are not understanding your friend correctly?

 

You have been asked many times by posters here if you even ever filed for CRBA. It's rather obvious now that you have not. So you, by your own thoughts, based on a friends perception of what is happening in her case have already decided that you can't get a CRBA. What you described for "your friend" has nothing to do with a CRBA.as no such proof is required. my thoughts to you is stop taking advice from your friend and instead get advice here where you have knowledgeable people who have actually gone through the process.

 

I stand by my last comment. You need a CR-1 and your baby needs a CRBA & US Passport. If the CO doubts your story when applying for CRBA they will have you get a DNA test. As long as the baby is yours and your asawa (the USC) you will pass that and be fine. 

 

I strongly suggest that you read the following document from the US Embassy in Manila regarding requirements for a CRBA.
