Hi there,

I recently came to the US on a TN visa from Canada.I have been married to a US citizen for 4-years and we lived in Canada.I now plan to do Adjustment of Status and apply for Green Card, did anyone go through similar process? How long will this take?Will this conflict with my TN status?

 

please share your experience.

Sounds like you entered the US with the intent to adjust status........

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I'm not judging. I said it SOUNDS like an intent ti usurp immigration law.....but who knows other than the OP.

Intent is determined at border by CBP. Since he is in the US now the officers obviously determined his intent was not to AOS. Also as the spouse of a USC - Intent is irrelevant once in the US so he can still AOS regardless of what his intent was.

Hello, I also did AOS from TN. The process was straightforward and took 6 months for me. I was able to work the whole time, TN is valid until you receive your EAD/AP card.

Thanks everyone for the info. Yes, was married to a US citizen for 4yrs and i didn't apply for Green-card while i was in Canada.

I am not getting married to a US citizen after entering the US with a TN visa, rather i was already married to a U.S citizen.Hopefully this makes big difference when it comes to the intent of my TN Visa.

Intent does not matter at this point. You will be fine. Just follow the guide above and ask any questions here. The a lot of collective experience.

Just as a note...

It's likely to take the better part of a year now (but some offices are much faster than others). Secondly, things have changed a little since you went through...you cannot leave the US after filing for AOS anymore until you get AP (or a green card). Previously, you could still travel on the TN visa with AP pending.

Being married already or not has no impact.

I just got my green card and held a TN for 16 years, married for 4 yrs.

Any questions I am happy to answer.

Have atleast 9 months on your TN before starting and the process may take 6 months( did for me).
