Can someone please advise me on how to package our documents? I mean with the old K1 evidence still intact, do I need to make our CR1 documents separately, or I can combine them in the same paper binder with the K1 stuffs? What is the smartest thing to do?

I wouldn't divide the two visas evidences...just group them together. I organized everything in a folder with tabs that divided things into categories.

For example:

  • Chats, call logs, and Skype history
  • Trip #1
  • Trip #2
  • Trip #3
  • Trip #4
  • Trip #5
  • Wedding
  • Insurance records
  • Letters of support
  • Etc.

Make sure you're adding more evidence to your case. What is needed for a K1 visa is different than a spouse visa. For a K1, you're wanting to show your relationship is geninue and you intend to marry in 90 days. For a CR1 visa, you want to show your relationship is real and that you've began combining your lives together.

There would never be any reason to include evidence for a K1 case with a CR1 or IR1 visa filing.  What is it you are actually trying to do?

If the petitioners K1 visa was denied in the past, they will probably reuse the chats, calls logs, and travel evidence they submitted for the K1 with the CR1 visa petition. That’s what we did then added to it with more marriage type evidence included.

Yea we were denied K-1 and have since filed for CR-1 so I think my husband wants to know should we combine old and new evidence?

Yes, combine the evidence but do not use a "binder" unless you mean a "binder clip".
