Hello everyone sorry to ask such an odd question but my fiance and I broke up she decided it was too hard to leave everything behind and move to America,  language and health conditions would be a major challenge. My question is I need to withdraw petttion he never received noa2 just noa1 if I send in a letter and they cancel it how long until I can petition again in the future?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I believe the answer to that is 2 years if thats your first one. If you want it before 2 years then you will have to ask for a waiver. After your second then you will have to keep asking for the waiver from now on.

Hi, attach the a photo copy of the NOA 1 to a letter that states your name and who you petitioned, state why you want to withdraw the petition sign and date it.

Send this letter and the NOA 1 copy to the California Service Center address.

Send it via delivery confirmation so you can be sure that the CSC gets it.

 

Petitions are taking 5 months or so to approve  and you are around month 4 right now.

Hopefully they will get to your withdraw notice and process it BEFORE NOA 2 because if NOA 2 is issued then it will take much more effort to get it withdrawn.

I jumped through that hoop already. 

 

If ever you do another I-129F you 100% have to list it on the form.

The waiver is free and more of a formality meaning unless you abused or murdered someone you will likely be approved a waiver.

The waiver is just a written statement by you and is attached to the new I-129F.

You can come back her for more info on the waiver if you ever get to that point.
