Hi all.

 

I am very happy to have found this forum, because it can be so difficult to find information about this.

 

I am a Danish citizen, married to an American citizen, who has lived in Denmark for 6 years. We met here in Denmark 4 years ago, and got married two years later. We have lived together in Copenhagen for the majority of this time. 

 

We have always had a dream of leaving Denmark and have finally settled on California, where his extended family lives. 

 

Now we want to start the process, and we know we have to fill out the petition form i-130 (and i-130A too, right?) 

 

We are unsure how to proceed, since we both live in Denmark. Does the affidavit of support still apply? I am the one here who makes the majority of our income, so does he still have to prove he can support me in the US?

 

Also, where and how do we send the application fee?

 

Thank you so much guys, I'll probably have a bunch of other questions soon.

Of course the US citizen have to prove that he can support the immigrant. If he can't, you need a co-sponsor.

Also, remember that your spouse has to show proof of filed US taxes.

 

And he needs to establish domicile (or at least show enough proof that he tries) in the US, or no visa for your. For example, job, address, bank account, house, etc. So the spouse will probably have to move to the US first.

I thought the Embassy in Denmark has a USCIS field office, therefor you should be eligible to file DCF (Direct Consular Filling) if they still offer it.

You can contact to Embassy to get an update if they still offer the DCF route.
You have to add a check to your application.
Since your husband is your main sponsor, he has to proof he will be able to support you when living in the US. If he cannot, he'll need to find a co-sponsor (like a family member)

For a spousal visa you file the following things;
I-130
I-130A
I-864 plus supporting documents
Proof of relationship

Well, we are actually unsure. 

 

We have contacted the Danish embassy, and supposedly it is all done in Sweden now. We contacted the Swedish embassy and they told us to file a petition, but they didn't tell us where to send it. So we kinda just assumed we have to send it to the Chicago Lockbox.

It's very common that some EU countries merge their field office into one. Like Amsterdam offers DCF but it's going through through Frankfurt, DE.  But I've been browsing some old topics, and it seems like Scandinavians can't do DCF anymore. Boo!

So it looks like you have to file through the Chicago lockbox. Your I-130 petition will be send to a service center and it'll take about 9-14 months in total. How are you planning on moving to the US? Does he have a job offer? Do he have a house there? There needs to be a domicile establishment done but that can also mean you moving in with the parents, for example. As long as there is a US address.
