What's the deal with Shona? I'm at work and don't have time to go through all the old threads...can someone give me the situation in a nutshell? :wub:

as i understand it - she had a NOID ( Notice of intent to deny) for her vawa petition, this is the hearing to determine if she has to leave the usa. :cry:

Fiiiiiiiiiiiine....what the hell does vawa mean?

Oh...so if I'm reading between the lines correctly (since nobody has actually answered my question), she was in the USA and was abused...and now is facing deportation? How does this happen? I thought abused immigrant spouses were protected under the law.

Shona came on a K-1, and her two sons came on K-2's; her USC husband (and his termagant mum were) quite abusive to her, so she divorced. Unfortunately, this happened in a span less than 2 years, at a time when Shona had not even completed AOS.

Bummer. I wish her good luck!

I don't know Shona but I wish her the best of luck. She will be on my mind. This is such a horrible thing.

We oldtimers know Shona very well. I think in 2004 I remember, Shona's ex MIL holding her incommunicado in the house without access to the phone.

She's been through a lot and she's is a very brave lady.

Hi everyone , thanks for good wishes,

Well I go into Detroit yesterday and stayed overnight. I went to the Courthouse today at 11.00am and the hearing was over in literally five minutes. I had the same judge as last time who was sweet and human. she allowed a continuance until the end of November in order to give me more time to sort out the NOID. This will also hopefully give me time to appeal if the NOID is denied. This in itself was a relief but of course I still have to deal with the Notice of Intent to Deny which is due in just under two weeks.

The judge was great, she wished me luck and asked if I was ok. I said this was very stressful and she nodded in agreement. Just a shame she can't adjudicate my petition. I felt like a person not just a case. It's always so nice to actually see someone in person.

.....well on with the NOID. If it is denied (which the attorney who went with me stated "It's virtually unheard of that a NOID is overturned) I have another lawyer who is putting my case together. They are kind of working together pro bono I have no reservations in appealing if I can and even going to court to testify and tell my story with witnesses if I have to. I want to be heard.
