License without EAD or GC

So I searched this forum and everyone has such different experiences and advice but just wanted to give everyone our experience of applying for a Maryland license with I-94 without a EAD or GC.

 

My husband and I just figured we should give it a try and see what happens. He did the online drug and alcohol course, written test and then took the road test. He was just granted a license for 10 months with just his NOA1 and an unexpired I-94 form for his K1.

 

So I would give it a try and see what happens. A lot of people say they get denied but he didn't.

01/31/17.... K1 Visa Approved

02/03/17.... K1 Visa Received in Hand

06/05/17....Arrived in the USA (LAX)

06/24/17....Married on Cape Cod <3

 

07/10/17....Sent AOS package (I-485, I-131, I-765)

07/17/17.... AOS notice date for NOA1 (I-485, I-131, I-765)

07/21/17.... Received mailed hardcopies of NOA1s

07/29/17.... Biometrics Notice received in mail 

08/01/17.... Biometrics Appointment AOS - complete (walked in)

08/07/17.... Biometrics Appointment EAD - complete (walked in)

10/23/17.... EAD/AP card delivered to house YAY!

It really depends on the state whether you can apply without a GC or not. Tennessee can be a hassle but they hand out an eight year valid temporary drivers license (don't ask me how eight years is temporary since the normal DL's are the same)

04/16/2019: Filed ROC  11/17/2020: Approved. (10 yr GC)

10/22/2020: Biometrics Reuse Notice.  12/22/2020: Online Status Changed to Interview Was Scheduled.  
01/29/2021: N-400 Interview - PASSED! 01/29/2021: Same-day oath ceremony.

Everyone in Maryland was saying he needed an EAD. The website even says it but we heard so many different experiences we figured he should try while he still has a valid license. 

 

I stalked all the Maryland DMV advice forums on here and everyone was saying not to try until you get an EAD because it is needed and even a couple that have tried and were denied without an EAD. But basically they were stating that every person in Maryland will give you a different answer, so we figured we would try and it went really smoothly.

 

Basically just hoping this information helps some other K1 AOSer from Maryland in the future :)

Timeline

I did it in Texas, I have a valid license for 1 year. I showed my I-485 797 letter (NO1) with alien number on top, I also took my passport and I94 which was expired but the thing that everyone has to be aware of is that once USCIS accept your application for adjustment of status it grants you lawful status, you can get a license anywhere, the local license office only have to check your status on the SAVE system. Good luck!

Thanks that is good information for people to know in the future! Hopefully someone with all these questions in the future will find this dialogue!
