Hi all! My husband and I are getting ready to send in the IV packet, and I am trying to make absolutely sure we don't get a checklist regarding our AOS. One thing I really can't figure out is whether or not my mother (our joint sponsor) should complete form I-864 or I-864A.

 

Here's the deal: I currently live in Japan with my husband. We will go back to the US together once he gets his immigrant visa. Because my current income is foreign income, when I filed US taxes I had to put that my US income is '$0.' So, my mother is the joint sponsor, and I am not combining my income with her's. We do not live with her now, BUT we plan to live with her (for only a few months) once we return to the US, until we find our own place. So..our princial residence is different now, but our domiciles and US mailing addresses are the same, and I guess she will be considered a household member once we move back. Will the NVC see it as a red flag if we have the same permanent residence in the US but she files form I-864 instead of I-864A? Which form should she fill out?

 

I've heard that I should just have her complete Form I-864 and then if she was married her spouse would do I-864A, but then I'm getting myself all confused by reading a bunch of different advice. The instructions for I-864A also state "If there is a joint sponsor, the joint sponsor may sign this form along with a household member" so maybe I-864 is OK after all??

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
