VAWA for spouse of TPS holder

Can a spouse of a TPS holder apply for VAWA? Also if she can can she still do it if they are divorced but the harassment and abuse continue after divorce? Thanks

I would guess no since that status does not grant permanent residence but only allows them temporary protected status. it would be like a person coming on a tourist  visa then saying thier foreign national spouse also on a tourist visa abused them.

no to VAWA, since you have to be married to a USC or LPR

 

but if you have enough proof and have gone to the police, you might be eligible for the visa U

Thank you for the replies, so here is another question. The abusive spouse will be eligible to be petitioned by a citizen son who will be 21 years old next year. If she stays married and he becomes an LPR would she then be eligible? They have separated already because of his behavior. Should she just wait?

she would be staying married for only a greencard.

someone correct me if I'm wrong but marrying just for a greencard is fraud so does staying married till they have legal status just to leave them when they get status would seem to be fraud too.
