Hi everyone, I applied and was granted the Visa Waiver Program which expired in March. By the time it expired, I was married and expecting a child with my USC husband. We filed the AOS which was received on 4/7/2017. Since I have 2 daughters, we were all included in the petition. We included the I-485, I-130, I-131, I-765, I-693 submitted our I-485 fee $1,140 (adult)/$750 (per child) ; I-130 fee $535. Other forms I understood to be free when filing concurrently. We got our first rejection where it was stated that filing fees were incorrect. So I figured it was the missing biometrics. We sent our packet out again, this time including $85 for each, even though both of my daughters are under 13. I got my packet back today with a rejection notice for incorrect fee and that a visa is not available for our priority date. It further read thats USCIS will accept AOS according to the monthly Visa Bulletin from DOS. I have tried reading that bulletin but can't make any sense of it. Can somebody please explain what the visa bulletin means and/or what I can do to send a better packet? Any and all help is greatly appreciated!

http://www.visajourney.com/content/i130guide2  - This states the fingerprint fee/biometrics fee is not needed for children under age 14.  So if you sent them the $85 for each child your fee amount submitted was still not correct and would be sent back again.  Third times a charm I guess.

since your husband is a USC and you filed I-130, you shouldn't have to wait for a priority date. Did your second package also include the I-130 or was that petition accepted? 

- if the I-130 petition has been accepted, you may have to wait with filing the i-485 again - which would explain the 'priority date' line: you'd have to wait until there is a visa available for you, which means the I-130 needs to be approved first.

- if the 130 petition was sent back as well, make sure you tell them clearly in the cover letter you are are concurrently filing i-130 and i-485 (and the rest of the forms). And include evidence of your husband's US citizenship (as listed in the required documents list, see http://www.visajourney.com/content/i130guide2)

Your daughters are under 14 years of age so therefore you do not need to pay the $85 biometrics fee for them, its only going to be a fee of $750 for the I 485 and $535 for the form I-130.

06/04/2017: Biom appt letter rec'd for child's form I-765

06/14/2017: Biometrics done.(for child)

06/14/2017: Both Forms I-485; Ready to be Scheduled for Interview.

08/18/2017: EAD, new card being produced.(day 108)

08/23/2017: EAD, card is being mailed (day 114)

08/26/2017: EAD card received (day happy)

The adult fee does include biometrics and should be $1225, but I think you knew that now that I read it all..
