Help me pls...my fiance and i are filling up the form for k1 visa..I feel confident coz it seems like i have no problem with my divorce papers that it doesnt need to be recognize here in the philippines anymore. Almost10 years have passed from the day i got married, and 9 years that i got separated with my ex husband, we decided to get divorce and I came back here in the philippines after almost 2 months of being together with my ex in germany..I recieved letters from germany, summons and certified copy of the petition for the divorce of marriage dated oct 28,2008, together with certified copies of the decree and its all translated in english from german. After a month i again recieved another letters from the court in germany, its not translated to english so i didnt bother to read it..Till i decided on getting married again to my fiance from US, we filled up the form (i-129f)..Only the copy of my divorce papers that i need to provide and give him a copy, and as i am scanning my papers it came into my mind if these german translated in english are the one that the USCIS needed? well, i checked the other papers that i recieved and i tried to translate it in english using online translation, this one paper got my attention and has a written word "Beschluss", same word written from my other paper that was sent to me that's already been translated in english, but both has different content, I was thinking that maybe it is the final decision of the court from the divorce paper that has been filed and its the paper that the USCIS and the embassy needed. While trying to translate it in english i found out that it has been rejected by the court. Omg!! After many years i only found it out now, never been thinking that it will be a problem in the future..:'( i feel super sad :-( What am i going to do? Help pleeeeease :-(

Contact your Husband and ask him to divorce you.

Are you sure in your translation? What does it say - Beschluß means decision, so you are right in those papers being the final decision.

There's a bunch of websites but some is concluded here about divorce in Germany

it goes on to say that you need to have been separated for 1 year to fulfill German divorce requirements. If he filed right after you came back to PI - that wouldn't make you eligible.

Yes that's your divorce decree. Like others mentioned Beschluss means court decision, which is the decree USCIS will ask for. Make sure you find an authorized translator to do the work for you (it'll be expensive) but yeah you need these papers in English. I would translate both papers to be sure USCIS got everything in their hands.

We got married on november 2007, i went to reunite with him on august 2008..Before i left germany we have a written statement and agreed that both of us will not claim for financial demands and decided to get divorce..I went back home on oct 1, 2008..I recieved the petition for divorce on November 21, 2008 and a decree of divorce..and on november 13, 2009 i recieved another paper and thats the "beschluss" (decision)..and when i tried to translate the content of the letter it shows that "the application from 28 of august 2009 is rejected". And the order from october 8, 2009 remained without answer. There are also other papers i recieved last september 22, 2009. Im so sad :-(

Since it was rejected the other paper you got in 2008 couldn't have been a decree as you say. Seems to me you didn't fulfill the 1 year separated requirement and that's why it would have been rejected. At this point your ex might have already sent another petition - since it was so long ago, but ofc you should have gotten those papers, unless you moved and they didn't have your new address - you need to file again asap! You can file without him, since you have been separated for more than 3 years. I'm so sorry about this. If he hasn't already divorced you the best you can do is get the divorce wait for the decree (4-6 months I read) and then move on with your new life
