Hello participants.

 

I am hoping to get some advice from someone. 

 

The USCIS confirmed that an I-130 petition for me was approved in June, 2014. They also confirmed that a confirmation letter was mailed to my father's address in the US (as he is the one doing the filing). He is a naturalized U.S. citizen for over 20 years. I am Jamaican, live in Jamaica. I was born out of wedlock and I am over 21 years old and unmarried (not sure if this is relevant to the case at hand).

 

My question is, what is the next step? And is this delay to be informed of the next step normal? It has now close to 3 years.

from what i read you have about 4 more years to go. with this its a waiting game especially your category which is f1. your are the same category as me and 7 years is how long i have been waiting.  as long as u dont get married your are good. what year is your priority date?

Priority Date (PD) is like your spot in line. It gets assigned when they receive the I-130 petition, and you cannot apply for the visa until it becomes "current". Family preference visas are capped by year and by type. Your PD is pretty much your spot in line waiting for a visa to become available. Your preference category is F1 (unmarried sons and daughters of a USC, and their minor children), which has about a 7 or 8 year wait for a visa to become available.

Jamaicakim, what exactly is the priority date?

Priority date is when USCIS received your petition and assigned a date. You can see it in the 1st Notice of Action, which got your father or in the 2nd, which USCIS sent to your father, that your petition was approved. Check it.

Lain, thanks for you help.

 

I didn't actually see the letter. However, if it the same date that I see when I input that code that starts with "WAC" on the USCIS "check my status" section, then it should be June 26, 2014. The notice on the website confirms that USCIS approved the petition on that date.

No, your PD should be earlyer, when USCIS just received your petition, then set your PD. Then they usually take 1-2 years to approve it and forward to NVC, where it'll remain till your PD will get current. Your father had to get letter from NVC with your new assigned case number.

Ask your father to resend I-797 Notice of Action and you'll find out or call NVC and ask about it.

So I asked NVC. They sent me an email. My priority date is May 23, 2011.

 

On the June 2017 Visa bulletin, under "FINAL ACTION DATES FOR FAMILY-SPONSORED   PREFERENCE CASES"

the date for my class, F1, shows December 22, 2010. 

 

Under the other listing "DATES FOR FILING FAMILY-SPONSORED VISA APPLICATIONS", the date is July 22, 2011.

 

What's the difference here?

On the June 2017 Visa bulletin, under "FINAL ACTION DATES FOR FAMILY-SPONSORED   PREFERENCE CASES"

the date for my class, F1, shows December 22, 2010. ----this is for when your priority date becomes current and you are ready for interview.

Under the other listing "DATES FOR FILING FAMILY-SPONSORED VISA APPLICATIONS", the date is July 22, 2011.------this is when you receive your welcome letter and start the process of sending nvc your supporting and financial documents, pay fees and fill out the ds260 form

Final Action is when a visa is available to the beneficiary.

 

Dates for filing is when the NVC will start accepting paperwork for the visa application.  The beneficiary must wait until the Final Action date for a visa.
