Is it it too late to file

I understand that the K-1 requirement is to meet the beneficiary within a two years time frame. I met my fiancee in June 2015 when I went to Nigeria, but I didn't file the paper work because I was working on my daughter's immigration application. But now that my daughter is here with me I am considering on starting the K-1 petition. This year June will clock 2 years since I saw him last. Though we still communicate with each other and still want to get married, but I am scared of the time frame. My question is, can I still send in the application before June, and what if the application is pending when it clock the two years time frame. Please any advice is very appreciated.

From a technical aspect...yes you can file, the 2 years is from the date of filing, not when they actually process it.

 

That said, Nigeria is a very tough embassy to get through, so I highly recommend reading through the guides and front loading the petition. If the last time you saw him was 2 years ago, then they are likely to question the authenticity of the relationship. I really think it would be beneficial to have more/recent face time for such a difficult embassy.

geowrian is right... You can file for the K1 visa but since is a high fraud country the embassy is really estrict and will check every detail... If possible plan to see him and spend time face to face with him again... even plan to be there for the interview, that will give strenght to an authentic relationship

Since it is Nigeria it is strongly advised to make another trip before filing. You don't HAVE to. But it would be in the best interest of your case.

Thank you all for your kindly response. I am sending in the packet and I will try as much as I can to be there during his interview, because we sure enough photos. Though we have some pictures, but not much. I will submit the packet with the pictures we have, but I will try my best to go back during his interview.

Just note that the chances of ya'll being denied is incredible with ya'll only meeting once. While it meets the requirements to file the I-129F (you asking the government permission to allow your fiance to apply for a K-1 visa), it most likely will not meet the satisfaction of the CO for having a real relationship. It would be in your benefit to be at the interview without question because if the K-1's denied, your next option is to marry which will bring you right back there.

@Ash.1101 you are right about the requirement. My fiancee and I are childhood friends. We have been friends before I left Nigeria some years ago and we started dating two years after my divorce. I visited in 2015 when I lost my mother, though before then, we have been communicating and talking on the phone, but during my visiting we never spent enough time together because of my mother's burial, but during that time, we still manage to spent some time together. I am familiar with the Embassy in Nigeria, in fact my daughter told me the horror story during her interview, how people were being denied from  left and right. I will do my best to get this right.
