I am an active military member getting ready to deploy in May ending, I sent an expedite request twice with the memorandum from my commander and they replied that my case can't be expedite to be fair to other applicant, please what else can I do to expedite my petition so I can see my husband before deployment.

If you were denied twice that is pretty much it. You can't force them to expedite. You asked (twice) and they said no.

 

Now you just have to wait for the process to complete like everyone else.

Are you the US citizen , or are you the beneficiary applying for a greencard?  And what stage are  you currently at?  I would say that if they denied you twice there's not much you can do. You could ask your congressman to intervene and ask but ultimately its actually not NVC who decide, they simply send it to the consulate for an answer, and the consulate do have the final say.

Your congressman would only contact NVC, and the request would still go through the same process as far as I'm aware.

Case Complete: 14th April 2017 (10 weeks 4 days)

Full expedite approved (bypass NVC to send file to embassy), however too late as I already had case complete 17th Apr 2017

Case arrived at Embassy: 21st April 2017

P4 letter received: 26th April 2017 (expedite at embassy stage so this came from the consulate, not NVC)

Medical date: 26th April 2017

Interview date: 4th May 2017 APPROVED!!

Visa received: 8th May 2017 

POE (entered the USA): 15th May 2017

I guess from their point of view, as harsh as it sounds, if you're about to deploy then why would they rush your application because your spouse would have to then settle into the USA without you. I'm sorry if that's the case but I wonder if maybe that's how they see it?  You can find your congressman on this page linked below.  They have a form for contacting government agencies on your behalf. It is still very possible they'll say no if they've done so twice so up to you if you want to try.

How far through are you at NVC, how many weeks? Your timeline isn't linked so I couldn't see.  I've just passed 8 weeks ... I hit 8 weeks the day after they changed to 11 :-(

 Just to see each other before I go for another nine months journey away from him it been a long time since we see each other and more so, we have friends and family here to stay with when am away. Thanks for your help

I wish you well in your contact with the congressman then. I'm just saying how I think they probably looked at it when you sent your expedite request, but I hope they come around and help you out. You're almost at the finish line... I understand how you feel.

I have less than 6 weeks til my husband moves back to the USA and will have to follow him afterwards with our baby girl if I don't get approved in time to join him. Its so hard when we are so close to the end yet so far away.

I'm sorry they said no, its hard not seeing your husband for that long.  I know what it feels since my husband is in the Dominican Republic and I try to visit every 3 months.  My case just got approved :D so now I'm waiting to hear from NVC

I think your reason seems legitimate but not good enough. 

I think if your spouse was here already then the rest of the process could have been expedited for you.

Remember that even if it is expedited at NVC, you will have to wait and go through Lagos embassy without expedite.

So it is best to go for a visit before you leave. Anyone who knows that you have been denied twice will ask, what are your other options? Why wont you consider those?

But don't let it stop you if this is your only option. Keep asking.. Someone might approve it. Good luck!
