Mother in the US with tourist visa...can I apply I-130 for her?

Hi everyone, 

My mother is currently in the US (under tourist visa). She's been here now for about a month. I was just wondering, if I can petition her while she's here. I'm a US citizen.

Are you sure you're a U.S. Citizen? Your timeline doesn't line up, it says you're currently filing to lift conditions on your green card.

03-19-2021: Officially an American Citizen 🇺🇸 Entire journey from initial K-1 Visa filing to Naturalization took 5 years, 8 days.

Nonsense.  Many AOS from tourist visas sans scrutiny

OP never said anything about adjusting status. The way I read it it's possible that the mother has every intention of returning home at the end of her visit and the OP just wants to know if she can start the petition now already.

No such thing as a "90-day tourist visa" or a "6-month visitor visa". VWP eligible people can stay up to 90 days at a time but that's not a visa - it's exactly the oppposite: a visa waiver (visa-free entry). A B-2 visa is typically valid for 10 years and allows people to stay "up to 6 months" at a time - but the duration of stay is entirely at the discretion of the CBP officer upon arrival. Some people have been known to be authorized for as little as 2 weeks if the CBP officer only wants to admit them for 2 weeks. No one is guaranteed any entry except USCs.

My husband applied for my father in law at the end of Jan this year. He arrived back last Oct on B2 visa, originally had a set date to leave by beginning of April. You just need to make sure you apply and get confirmation letters back then your mother can stay even beyond the 6 months mark. Also, it is taking awhile, make sure she wants and can stay here without wanting to go back before she gets her GC, she will need to apply for a separate travel document which takes more money if she wants to travel in between.
