hi guys, im just about to start my petition for my husband. the problem is im not qualified for the financial requirements. 

we got married last 2015 and had child together, since then i have never had a job but to focus on taking care of our daughter. 

now that im back in the states, im focusing on studying to pass my NCLEX exam so i can start my career while my husband and daughter are abroad.

my question is, is it okay to put unemployed under the job description in the forms? 

is it going to affect the process? like i might get denied because i dont have any jobs?

i know that i can have a sponsor, and my cousin is willing to become my sponsor. but is it okay to just have the sponsor while being unemployed?

you still have to file the i864 as the primary sponsor regardless of income

 

you will put $0 income and explain in a letter why you didn't have to file taxes

 

and then your cousin will file another i864 as your only joint sponsor

I think it will definitely help to have a job, taking in count that you have also a daughter, and also that your cousin will have to meet the minimum requirements  to be your sponsor. The option of using more than 1 joint sponsor is always good too.

 

We are about to start the petition, (had a delay with he marriage certificate) and my husband received a new job offer, but that will start after we submit the G-325a. Even when we have 2 joint sponsors, the recommendation of our lawyer was to use that job even if he hasn't started because it is better than "unemployed" in the forms.

Yes, must be only one joint sponsor, however, if her cousin is married, he could use her wife as a household, and combining the income requirement for sponsor the immigrant.

 

Sorry if I didn't explain myself before, but that's how we are using 2 jointly income.

 

You didn't mentioned if your cousin have a household or not, so just providing you with the best option for "having 2" joint sponsor.

i see. thank you do much for your fast respond. 

is the form i864 the only form that my cousin will fill out as my joint sponsor? 

and i believe that i864 form is done on the second step, correct? i mean after the USCIS have received your i130 and G325a and other stuff?

or do i have to send it out with all my papers to USCIS?

im sorry for the additional questions. im just really confused with the processing and nervous at the same time since it is gonna be first time dealing with this kind of matter.

actually i have been applying to several part time jobs since i came here last january and i just got accepted as a part time babysitter and im gonna start next week. i might just gonna put that under my job description then. but if i put that, do i have to write a letter of why not filing a tax? or do i have to start filing for tax since i got a job even though it is only a part time job?  im sorry if i have an additional questions to you. it is just so confusing. 

and actually my cousin is married. that way i can ask my cousin and her husband to combine their income to become my joint sponsor then.

I believe part time jobs count as well as a job, it doesn't matter the time, the activity, but the fact that you are working.

 

About the taxes I don't know enough about it, so before giving you a wrong information, better wait till someone else with more experience in here help you with that, or you can start searching about:

If you haven't been required to file taxes, you must attach a letter explaining why. 

 

Taxes for 2017 is filed the following year, in 2018. 

 

Just bare in mind that even USC living abroad must file taxes.

 

Did your cousin file as married filing jointly? If so, it's probably easier for the cousin to do the I-864 and his wife does the I-864a. If the filed as married filing separate, then I would just go with the cousin's income, assuming he meets the poverty guidelines for his household size.

Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning
