Hello VJ Members,

My NY driving license road test is scheduled to be on 6th of feb, 2017. I do have NY driving learning permit and is going to be expired in 1 week due to k1 90 days. I already got NOA 1 from AOS and have biometric appointment on 11th of January, 2017. I am supposed to get EAD/AP at the end of Feb or earlier March, 2017. Given that scenario, what do you think what should I do? Would DMV accept my NOA1 as evidence for my permanent residency? I do have SSN too.

If you already have a driving learning permit then all what you need to show is your Social Security card. 

 

f you do become a resident, you must apply for a new driver's license within 30 days. You will need to:

  • Complete a pre-licensing course.
  • Obtain a permit by passing a written test.
  • Pass a driving test.
  • Show a Social Security card or letter of ineligibility from the SSA.
  • Surrender your foreign license upon receiving your NYS license*.

Okay. Yeah I already have everything except for EAD/AP and Green Card. I am afraid what if DMV wont approve my DL due to residency problem?

Well, all that I have to say it does not hurt to go and try. Take your NOA1, current address with you in case they question you. But most likely with the SS you should be fine. If it does not work out, then you just have to wait, but I don't see why it would not work out. Good luck.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Thanks ... seem no point to have it now ... is your Lerner permit will still valid till you get the EAD. Or you have to get a new one since it will expire with the i-94? 

I have an appointment at DMV later at 1pm.

Well you can get learner permit as it is valid for 5 years but then it will expire with i94 date (restriction due to residency).Once you get your EAD or green card, you will just go to DMV office to renew your learner permit and then you will just to need to give road test.

Well that make sense but I'm wondering about the fees. The website say to get a learner permit is around 70$ I don't know if I have to pay same to renew it.

Here it say you will have to reapply over again. https://dmv.ny.gov/driver-license/renew-learner-permit

i will skip this part till I get EAD. Don't want to pay twice the fee 70$.
