Hey Guys

I was recently approved for my K1, on my birthday/24th Dec. :D

Few questions:

1) I have a contract I need to see out here in Aus before I enter the USA. My Visa expiry date states the 15th June 2017. Does this mean I have until then to move? (My contract ends start of June)

2) Does anything expire? ie: the petition? Or is it just the date of the visa? If stuff expires, can I get an extension?

3) When I arrive, is it better to apply for the EAD/AOD together because I need to work ASAP or I'll go crazzzzy. I have read mixed reactions. We plan on getting married basically as quickly as possible after my arrival.

What a great birthday present!

1) Yes.

2) The visa.

3) Apply for AOS/EAD/AP together (treat as 3 separate packages that happen to be mailed in the same envelope).

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Even if you marry the day after you arrive and file for AOS it will still be anywhere from a few weeks to a few months before you are allowed to work. Average is about 3 months.

Ohh that's fine. I mean just for my sanity. I have savings, I'll just get bored.

I think the medical examine expires after 6 months.

During the medical exam my fiance asked for clarification because our wedding is June 24th and he plans to enter the country June 1, 2017. His medical Examine was this month.

They told him the medical examine expires after 6 months. Which I believe at that time makes the Visa invalid but you will want to check those facts. I have seen a couple of people talk about this before.

01/31/17.... K1 Visa Approved

02/03/17.... K1 Visa Received in Hand

06/05/17....Arrived in the USA (LAX)

06/24/17....Married on Cape Cod <3

 

07/10/17....Sent AOS package (I-485, I-131, I-765)

07/17/17.... AOS notice date for NOA1 (I-485, I-131, I-765)

07/21/17.... Received mailed hardcopies of NOA1s

07/29/17.... Biometrics Notice received in mail 

08/01/17.... Biometrics Appointment AOS - complete (walked in)

08/07/17.... Biometrics Appointment EAD - complete (walked in)

10/23/17.... EAD/AP card delivered to house YAY!

If you have the visa it should have an expiration date.

Applying for EAD before the AOS is expensive and useless. It takes 90 days to get it and your I-94 (legal stay period) expires in 90 days after arrival. So get married and file the AOS asap.

If working was super important then a CR1 visa would have been a better choice.
