DS-260 Question - Citizen Children Immigrating?

When filling out the DS-260, here's the question.

My husband is the beneficiary. I am the petitioner and the US citizen. We are both living out of country with our children. The kids are all US citizens due to birth in the US or CRBA. So here's my question:

It asks "Will the children be immigrating with you?"

What is the answer? The children are coming but not immigrating because they are citizens.

Any thoughts?

10/12/2016 : Transferred to Texas Service Centre

10/26/2016 : Approved!???

11/08/2016 : Case sent to Department of State

11/15/2016 : NVC Received

11/23/2016 : Case Number & IIN received (confirmed through phone)

11/23/2016 : Submit DS-261

11/25/2016 : Welcome Letter from NVC & AOS fee invoiced

11/26/2016. : Pay AOS Fee

12/01/2016 : IV fee invoiced

12/01/2016 : Pay IV fee

12/05/2016 : Submit DS-260 online

12/09/2016 : Mail AOS & IV packet

No because they are not immigrating they are just going "home"

Assuming they already have their US passports.

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

I answered NO.

They are not "immigrating" meaning there is not and will not be an immigration visa for them.

Use the CRBA cert to obtain passport(s) at a US consular post overseas. Something that should've been done alongside CRBA.

He has a passport, a Canadian one. At the time of filing the CRBA we did not think we would be moving back, so we did not get him a passport.

He has a passport, a Canadian one. At the time of filing the CRBA we did not think we would be moving back, so we did not get him a passport.

He can't enter with a Canadian passport if he is a US citizen.

1. Re: original post, children would not be immigrating with you.. as they're already US citizens.

2. They require US passports to enter the US, which should be obtainable with the crba Certs.

Anyone with kids here? I'm the USC spouse living with my Canadian citizen spouse and 3 kids in Canada. It's not practical at all for me to go down before the end of the school year. If I register my kids in school will that cut it with Montreal? I'm getting a little scared of them, based on what everyone is saying. I'm a stay at home mom so I don't have a job lined up and neither does my husband, yet. Also not practical to apply for jobs without knowing when he'll get there. Same goes for buying a home/renting. I'm still waiting for the NOA2, filed in September. Planning to get moving company quotes as well. I also have a US bank account and mailing address (my parents), US passport receipts for my kids, proof of contact with real estate agents, maybe a school application for myself.

Any thoughts? Really don't want to have a problem.
