Hello my lovely VJ family,

My husband and I just received a letter from USCIS requesting more information that was to be provided with the i864. I thought I did this correctly, but now just have some questions upon receiving this letter.

1. It says that I need to submit a complete Federal Income tax return for the most recent year. Is submitting a tax transcript (per this page: https://www.irs.gov/individuals/get-transcript)the form I need to submit for that? If not, can someone let me know how to find a copy of my actual tax returns to send over to USCIS?

2. The letter also states that based on my documents that I've provided thus far, that my income does not meet the 125% of the poverty guideline. I remember doing the math upon filling out this portion of the application and remember meeting that mark. It could be that my documentation was out of date--but just in case, does anyone know where I can calculate whether my income will be enough for me not to need a sponsor? Note: I have a full-time job and make $23/hr. Roughly that is $44,160/year. Also, it is just my husband and I in our household--no kids or other people to support besides ourselves.

I don't come from a rich family so having a sponsor isn't exactly on my to-do list. But, if anyone has any tips for finding a sponsor (in case i'll need one), feel free to send 'em my way!

1. Do submit Transcript for 3 years. If you are to submit Form1040 you must include W2s as well. But Tax transcript is preferred and much easier to get actually. 5-10 business days mailed to you if requested online. Or you can directly print it out.

2. Ask Employment Certificate from Employer stating your estimated annual Income this should have a company letterhead and signed in wet ink. I know there is a format of that here in VJ. You might need a bit more research on this. God bless on your journey.

You can include a complete copy of the return, which is all forms, schedules, attachments, W-2s and/or 1099s, or an IRS transcript. One is not really preferred by the USCIS over the other. Both are stated as acceptable in the I-864 instructions. It is just easier to deal with the IRS transcript because you do not have to worry about whether or not you included a complete copy of your return or not.

Also, you do not need to include the last 3 years of transcripts. Only the most recent year is required and is exactly what your RFE is requesting.

When they send an RFE for a missing or incomplete tax return, it will always state the income is insufficient. It is a boilerplate RFE letter. When they do not have the required tax return, they seem to just stop and not even check the other documentation. You just receive this RFE letter.

Your income more than meets the requirement for a household of 2. Point out that you more than meet the income requirement for sponsorship of your spouse because you make $47,840 annually($23 an hour at 40 hours worked per week and multiplied by 52 weeks). You need to provide a letter from employer and/or recent pay stubs to prove that current annual income amount.

Regarding the letter of employment, I don't work on an annual salary and only receive a hourly wage. Do you think as long as my letter of employment shows my hourly wage amount and that I work full-time that will be enough?
