This is a long story/question so I hope someone reads it :)

I lived in the US several years (illegally). I left the US voluntarily. I applied for visitors visa and was denied and got a 10 year ban that ended Aug 2015.

My GF and I decided we should get married. We submitted the paperwork and last week received an approved NOA2 and are now waiting for NVC case number to set up an appointment.

I am assuming because NOA2 was approved by USCIS I will not have an issue with this during the interview? I understand they can ask about it, just afraid I may get denied because of it.

*I guess the real question is "will USCIS check your immigration status before approving your K-1"

You are confused. Their are many different visas in USA. You came and overstayed and once you incur the ban.. You could have stayed..once u left you triggers the bar

If you Never left u have no ban. Stay and get married. No uscis. Does not care except that you entered with and inspection. If you leave you trigger the 10 year bat then you won't get in...as long as you don't leave yu are fine

No use stressing now you will find out at the interview. The 10 year ban does that come in effect when you left or from when you tried to get the tourist visa...that would be the question because if it's 2008 the you have more time on your ban.

If the ban is over then you know at the interview if you are eligible for waiver,

getting an initial petition approve is no indication of being approved for a visa,

initially the petition is checked for being bonafide family or mate.

You have to wait for interview & if a waiver is required then you retain a WAIVER atty

He wasn't deported or escorted outside USA .. he left voluntarily .. deportation ban is 10 years in some cases 5 years.. so I guess you re fine since you left the states more than 10 years.. Good Luck

Wow, So I want to thank you all for your comments. Especially KayDeeCee :)

What I gather from all your comments is that I will be told at the interview If I have an active ban. Oh, well. I guess I must wait and see. I should get a case number from NVC by the end of November to set up an appointment. I will definitely update this thread and let y'all know how it went.

And about my odd ban dates. Although I was banned on Sept of 2008, I was told by the agent that because I was working in Mexico sense 2006 it showed I left the US some time in 2015 and that's when the 10 year ban started Sept2005 to Sept2015. - I hope this part made sense.

Little personal background for those interested: I was taken to the US as an infant and left the US at about 20 yrs old (I am now 31). I was never deported nor was I asked to leave. I left on my own because I wanted to travel the world and as an illegal alien I would never be able to do this. Met my Fiancée while in HS (2002-2005 more less) and we stayed in touch sense my departure via skype and calls on a weekly bases. We took a trip to Niagara Falls and Toronto back in 2014 and hit-it-off so we started our long-distance-relationship. We decided in 2015 we should get married. And here we are now on this forum XD

Not sure why the mention of being banned in 2008. Some of your dates are making this a tad confusing. If you left the US 11 years ago at the age of 20, that would have been 2005. The bar begins from the departure date. So if you left Sept. 2005, then the bar would expire Sept. 2015. If you did not actually depart the US until 2008, then your bar will not expire until 2018.

No clue what working in Mexico in 2006 and leaving the US in 2015 is all about. You lost me there.
