uscis is giving me problems with K1

Thanks for your service. However, being a military man and also working at the Pentagon I would hope you would be familiar with doing things carefully and also reading over instructions provided by government agencies that, while can seem challenging, do tell the individual how to proceed to properly file documentation. When filing a K1 visa, even if an individual has no clue how to proceed, the USCIS does provide ample instructions. I wouldn't say they are 100% complete instructions as to what to expect, but in terms of bare bones paperwork, they do tell you which documents are required in the packet. If it seems very challenging, people usually turn elsewhere for clarity. The EAD application is not one of these documents. It tells you exactly what the cost is. It also explicitly states that you do not get refunds, and that includes any money provided to them in error. Someone has to match up and handle all those documents, even all the incorrect ones, taking up time and money.

The money you lost is not the USCIS' fault, but it is due to your error. We all have had our own unique dealings with the USCIS, some pleasant, but probably for most there is some part of the immigration process that caused a great deal of stress, hassle, or reason of complaint. The timeline in which you expected your new family to arrive is unrealistic, but is a frequent unreal expectation from those just not familiar with the entire process. So you're here now. I suggest that you read up on the process again with the guides, and follow the very sound advice individuals have given you instead of lashing out. The divorce issue to the USCIS is important. They are trying to stop fraud and persons from breaking the law. If you cannot provide a divorce document that meets the requirements, how are they to proceed legally? The burden of proof is upon you. There are couples that run into interesting and difficult situations all the time, who come from war-torn countries or countries that have a confounding system with regard to paperwork, they usually do what it takes to properly resolve those challenges. I hope that you can too. Consult someone experienced in these matters in Japan sounds like a good idea, and I believe there are also investigators or attorneys could also chase it down. Chase the ex to see what she has. You can work with senators and congresspersons. It's their job. It has nothing to do with her race or national origin. The burden is on you. Start again. Correct the problems you are facing. Educate yourself and move forward. It's the only thing you can do now.
