hi, guys

while we are on the I-864 topic, i have a question needing your help in answering. when we send our income tax returns, do we need to send along the State's income tax return and not just the federal or 1040?

i ask because the entire federal and state income tax together is quite thick. and if i send this by email, it would definitely populate my old computer.

if you are answering my particular question re tax returns., i actual;ly have hard copies of my returns and don't need to get the transcripts, as one's hard copy is acceptable, too. so i ask again, is the state's return included in the submission to NVC.

no but why are you spending more money on shipping? Also tax transcripts are preferred.

to those who have gone thro NVC, may i ask for your help in re submitting tax returns in the affidavit of support.

I am an income tax preparer and, therefore, have copies of my returns in the last years. i read that tax transcript is required for submission. While someone here said tax transcripts are preferred by NVC, a lawyer's blog says we can submit either of the 2.

I have made 3 copies of my hard copy tax returns for the last 3 years .as well as all the evidentiary W-2's, 1099s' and other income source. and have therefore spent for the copying.

But if it has been your experience that tax transcripts are better for reasons you know , then am willing to go that route, too.

I would really appreciate if you can help me with the ff. questions::

: 1. Must i insist to get the transcript for a more successful result?

2. Do we pay for transcripts? If yes, how much?

3. In submitting our tax returns, is the State (mine is NY) tax return included? or not?

Thank you very much for your time and kind attention.

I advice you to get IRS transcript along with your Federal Return. You cannget your transcript and printed by opening an account at www.irs.gov. It will give you all the tax that was submitted and you have to option to print it out

I don't think one way is more or less successful per se. The I-864 form specifies that either can be sent. However, it is important to note that if you've filed jointly in the past with your wife, you will need to submit a 1099+W2 in order to highlight YOUR specific income. If this is not the case, you can submit either a tax transcript OR 1099+W2 (do NOT do both).

2. Do we pay for transcripts? If yes, how much?

Tax transcripts can be obtained free of charge at the following website. You can either request a paper copy to be shipped by mail OR download PDF versions online.

3. In submitting our tax returns, is the State (mine is NY) tax return included? or not?

Please read the instructions for the I-864 form, it specifically states "Do not submit copies of your state income tax returns". So, no, do not include state tax returns or ANY foreign tax returns you may have filed.

no, i have not filed jointly yet as she is still out of the country and the narriage was in may, 2016 after the tax filing deadline.

i will file jointly once she is in the country. before the april 15 deadline. if not, i file singly and then amend it later.

Just so you're aware, by law you may not file as "Single" once you are married, regardless of whether or not your wife is in the country. You MUST file as Married (Filing Separately) or Married (Filing Jointly). This is very important as it's another piece of evidence of bonafide marriage and more importantly, during the interview they MAY ask for your most recent tax return and if you've filed as "Single" this could lead to trouble.
