Timeline

Hi guys im a k1 visa and im here in the US already and married.. I just wanna know do i need to file my AOS urgent. Coz my visa will expired on oct 24, do i need submit all my documents on oct 24 or we could just submit it after oct 24. Coz some of my papers are not yet ready.. i just really want to know.. thanks

Your visa was invalid the moment you cleared POE, your legal status for being in the USA is now controlled by the I-94, which is valid for 90 days from POE. Do go to the CBP website to download and print out a copy of your I-94.

There is no requirement to submit the I-485 (AOS) and related documents by a certain date. Still it is best to get AOS filed as soon as possible.

Yes you can file after Oct 24. Reread Sagot's post and follow his instructions and you will be fine. Again, get the AOS done as soon as you can.

Nope. No fee for filing later.

Just make sure you complete AOS within a year of your medical in the Philippines, if not USCIS may ask you to complete a new medical.

Complete the I-485, include the required supporting documents.

Complete the G-325A. https://www.uscis.gov/sites/default/files/files/form/g-325a.pdf

Complete I-864 with supporting documents (page 4, section 9a). https://www.uscis.gov/sites/default/files/files/form/i-864.pdf

Certified copy of marriage certificate.

Copy of DS-3025 (page 4 section 7c) ... highly suggested to attach a copy of page 4, with section 7c highlighted to the DS-3025

Copy of I-94

Copy of the NOA2

Copy of your visa in your passport

Copy of foreign birth certificate

2 passport style photos (2X2)

You can also complete the I-131 (Advance Parole, travel document) free to file with the I-485. Also you can complete the I-765 (work authorization document) free to file with the I-485.

No, you can file the AOS after that date. It is totally acceptable to do that, but just know the later your file for AOS the later you will get the green card. Also make sure you have already got your SSN na.
