Passport Expired while in US - have 2 year temporary visa

Hello,

I am not sure if this is the correct forum, but I have a question.

I received a 2 year temporary visa because I was married for under a year when my spouse applied for my IR-1/CR-1 Visa.

I have to apply for an I-751 in a couple of months.

My passport for my country expires in 2 months. Do I need to wait until my conditions are removed to renew it, or can I renew it now?

You can renew it whenever you wish.

Just for clarity's sake: you do not have a visa, you are a LPR (legal permanent resident).

In general, you need to maintain a valid passport from your country at all times. Here I quote from the USCIS website, "you will need to present a passport from your country of citizenship or your refugee travel document to travel to a foreign country."

Most countries allow passports to be renewed months before they actually expire. So I would suggest that you should renew your passport now.

Yes, renew now, in case the ROC takes longer than you think and you have to get a stamp in your passport! (if the ROC takes longer than your NOA is good for, you need to go into your federal office and get a stamp in your passport to show your application is still in progress)

When my wife had her biometrics taken, they asked for her passport as a valid ID. The best thing to do is get your passport renewed asap.

Dec 2, 2011 - Vivian traveled to USA to attend a medical conference and had our first date. On Dec 10, 2011 - Vivian returned home.
May 15,2012 - Vivian traveled to USA to spend a month with me. smile.png
