Out of status with an approved i-130 and current priority date

Hi,

I filed for my spouse in 2014 before her I-94 expired.

Her I-130 has been approved and her priority date is also current. We were about to file for her change of status when we were told she's out of status. I'm yet to become a citizen. What's the best advice ?

Become a US citizen so that she can file an I-485 as an immediate relative.

If that's not an option, she would need to depart the US and interview in her home country for an immigrant visa, which would be denied due to her overstay. She could then file an I-601 seeking to waive her inadmissibility.

She can't become an LPR until one of those two things happens.

how do you mean? She came in May 2014 and was meant to go back. We got married in September 2014 and i filed for her in October. That's about it.
