AOS still not filed Six Years Later.

Timeline

Most states will issue a Drivers License with only requiring a SSN card and Birth Certificate, thats all i ever provided for each of the 3 states I have lived in and was never questioned to provide more. And as far as I know you dont need an EAD to get a SSN or DL.

I just want to interject....Even police officers dont really care if your "illegal" at least here in CA. If you get pulled over as an illegal immigrant and have not committed a crime they dont call ICE... ICE also doesn't patrol around and look for people. They dont have the budget for that. I have inside knowledge of this process and It drives me crazy when people fear monger, like ICE s going to show up and deport a K1 overstay? have you guys read the news? people here who have NEVER had any status are let out of jail....routinely.....

Just stop with the trying to freak people out for no reason.

What a USC and a non-USC need in order to obtain a state ID or drivers license are not equal. If you are not a permanent resident, you do not have a green card and will need to show legal status via another document. Usually they will accept the EAD and issue a license based on the EAD expiration. If you check the requirements for many states, you will see that at least an EAD will be needed. For someone that hasn't even filed for AOS, they have no legal status in the US and no proof to provide. Their SSN and foreign birth certificate will not be enough for them.

Not just any non-resident alien can walk in and receive an SSN. You must be eligible. If they did not receive the SSN at least 2 weeks before the I-94 expired, then they will need the EAD or green card in order to get an SSN.

This person has been out of status for 6 years. They have no valid visa or I-94. And in the states where they accept the unexpired visa/I-94, they tend to issue a temp ID/license valid only as long as the I-94 is. Better to wait for the EAD and get a temp one valid for a year rather than for only 90 days. And if no valid I-94, EAD or green card, then no SSN or state ID/license.

There was a case here on VJ years ago where an overstaying K-1 and her husband were on a road trip and stopped at an inland DHS check point and she was detained.

Can't remember exactly what the outcome was...something about having to file AOS in a hurry. The alternative would have been eventual deportation.
