Hey all,

I have filed for a K1 visa on June 2016, got my NOA1 mid-June, and got my NOA2 today (no RFEs :) ).

It is really important for me that I would be able to enter the US no earlier than May 20th 2017.

Meaning, if I went and done my medical exam anytime soon, then that starts the "countdown" of 6 months validity of the K1 visa that would be produced, right?

I need some advice/tactics to "stall" the process as much as possible, so I could have the appointment at December this year, or even a little later, and then my K1 will be valid for my entry on the end of May 2017.

This is all mainly because of work issues that I currently have (I kinda have to keep my position in the company I work at in order to get my stock options), and also we would like to have a vacation in the US on November this year, and if by then I would have my K1, then we wouldn't be able to do that since they would "stamp" my K1 as being used...

When your file has reached your consulate, contact the consulate and request a December or January appointment.

By the way, it would help if you completed your VJ timeline. :thumbs:

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I know timelines are important here but I make a point of just writing it at every post... It is really short anyway..

Is it normal to ask for appointments so far in the future? Wouldn't it raise questions?

Also, if I just don't contact them, will my approval expire in any way?

Re: timeline, click your username on the upper right corner, then go to My Settings, then once in settings, go to Signature. That way, you won't need to repeat your timeline in every post, even if it's short. :)

1. The consulates understand that people have lives. Were they to ask, you'd have plausible answers.

2. The consulates can extend petition validity in 4-month increments for up to a year. However, it's not always automatic, so it's prudent for you (and shows courtesy to them) to ask for petition extension at the same time that you request your remote appointment.

Sorry for this got me a little confused.

I understand I have to call the consulate in order to set my appointment. But I thought I could just ask them for a later appointment time like you suggested (let's say January 2017).

What is this "petition validity" you mention? And what is the remote appointment? The same appointment that everyone has (aka interview)?

I would love a clarification on this, exactly on who to call and ask what for what....

The K1 Petition is Valid for 4 months after approval. You would need to have your interview with 4 months of your approval date. Calling the Embassy and telling them the reason why you need to delay it will extend it. Also, make sure when you get to your interview you have a new Letter of Intent to marry from your USC Fiance to confirm that they are still interested in moving forward with the petition. This is needed as proof that the USC is aware of the delay and agrees to the delay.

I have to do this process as well. I was advised to trickle in the information little by little. For example, NOA 2 in August, fill out your DS 260 form in October, Schedule your Medical in December, and Fill out your applicant readiness form in December and pay your visa fee as you fill out your readiness form. Then once your readiness form is in you can schedule your interview for January.

You don't have to use the time frames I listed above, just do what works best for you with your work schedule. Just make sure you get a new letter of intent to marry from your USC fiance with your I-134 paperwork that is dated close to your interview date.
