I just found out yesterday that I received a NOID ( Notice of intent to deny) for my vawa petition. After nearly a year an half of waiting this has devastated me.

Shona, I am just getting back on line and am busy catching up with things on here and am terribly sorry to read this, I feel for you as I know what you have gone through, is there nothing that you can do. I hope there is Shona, it seems so cruel to have got so far. I pray that it will all work out for you and your son in the end. I am keeping you in my thoughts

I have about 5 weeks to address the issues why they are going to deny me. Part of me wants to really fight this because I was abused by my ex husband. The other part just feels like giving up. It's like going through all the abuse again having to find further evidence some of which i just don't have. My attorney is ok but I feel, becasue I can't work and pay him much, that he is not really in this with me. I can understand , it's his job.

What hurts too is that I have a wonderful "friend" who has made my life so happy in the last year, and most likely I will have to leave him.

The NOID will contain the reason that USCIS intends to deny. Please note that a denial has not yet been made. In VAWA cases a NOID is not an outright denial, but rather a request for further evidence that would be needed to affirm the case pursuant to 8 CFR § 204.2©(3)(ii). If USCIS later denies the self-petition the applicant may file a notice of appeal with the Board of Immigration Appeals (BIA) within 30 days after the date of the final decision to deny. Alternatively, the self-petitioner can file a Motion to Reconsider or Reopen with the Vermont Service Center for a fee of $110.00 for these motions, but a fee waiver may be requested.

I'm sorry to hear about the NOID, Shona. But it sounds like it's not the end of it yet. You've gone so far on this hard road ... don't give up now nor lose hope.
