Greetings,

What are the implications of leaving the country during removal of conditions? My sister-law went home during the process and she was asked to do fingerprints but she couldn't come back for them as her card is expired. We asked to reschedule which they did- now they sent her another request for fingerprint.

Any suggestions? Can we ask so she do fingerprint overseas?

She should have received her extension letter that would allow her to travel with her expired green card. She will need to do her biometrics in order for her application to be processed.

Was she not able to come back as in CBP would not let her back into the country? Did she go to her local office for an INFOPASS appt to get an I-551 stamp as her extension letter had expired? I don't know what options are if her GC is expired as well as her extension letter and no I-551 stamp in passport.

The letter of extension is valid for 1 year.

The Biometrics is done pretty early of the I-751 process.

Have she left US for 1 year already?

If she failed to appear for her Biometrics, the I-751 could been denied.

Start over with Spousal visa I-130 / IR1 process.

Done with K1, AOS and ROC

Is this a second round of biometrics? It is very weird that she would have an appointment close to the expiration of the 1-yr extension. Usually it's about 1 month after the NOA/extension. Why did she not return before it expired? Maybe there are extenuating circumstances for her non-return that may help her. Why did she leave for a whole year during her ROC? That's very odd!

Then she returned again because she wanted to make sure she gets back before the extension letter expired. The assumption was they will contact her before the extension expires but they did not. She waited and waited but she couldn't take it anymore and left. I advised that we file for advance parole before she leaves but honestly she was tired of being here without being able to work or permanent place to stay as she was staying with us most of the time. Unfortunately, shortly after she left, biometrics notice showed up.

Even if they did not contact her before the expiration of the extension letter (which I would have expected as well), why did she remain outside of the country after it expired? Were there extenuating circumstances?

So are you saying that the initial biometrics appointment was more than a year after applying? That doesn't sound right and is the part that people are confused about.

9 FAM 202.2-6(A)(c )(2) and 9 FAM 202.2-6(D)(a)(1) contain information about getting a transportation letter from a US consulate for conditional LPRs while ROC is pending and the green card is expired. She could try getting that.

I have no idea why she has a 2nd round of biometrics or why she allowed the extension letter to expire. She also seemed to reject the opportunity for AP. Seems she abandoned her ROC to work in her own country.

What do me she wasn't allowed to work? The extension letter extends her green card, including her ability to work.

She could have gotten her SSN and worked at any time with her conditional green card...she didn't have to wait for removal of conditions....
