My wife and I has been married for 3 years now and she just got her Permanent Residence a couple days ago. Before that I, i called USCIS and asked about the status. I also asked them about citizenship for her. She asked me how long have we been married so i said 3 years. She said my wname is fe could file for citizenship as soon as she gets her Permanent Residence Card. Is this true?

No, it's 3 years from the issuance of the GC and if you have been married for the entire time. She has to have been a permanent resident for at least 3 years.

Nope. She has to have GC for three years and she has to be in marital relationship with you for three years on GC to be able to apply for citizenship.

OMG, why would they say this to you? As others have stated, citizenship has nothing to do with the initial date of your wedding. She can apply 3 years minus 90 days from the issue date on her GC as long as you are both still married and living together. Shame on that USCIS representative!

I am confused...you said that your wife just got her permanent (10-year?) green card--did she have a two-year green card before then? If so, then it is the date on the two-year green card--the date she became a LPR--(along with the three years married) that allows her to file for naturalization.

If they've been married for two of more years, the immigrant gets a 10-year unconditional green card.

I have been married since 2008 and I come to states 2 years ago didn't mean that i am able to apply for citizenship i have to wait another years since on my green card since Resident on Green card counting days and times to be here 3 years before u can apply for Citizenship to be married US Citizen

Thanks...I was confused because I couldn't tell if the OP received the permanent green card in response to an AOS or ROC. I understand that if the GC was in response to AOS after two years that they would get the 10 year GC---and not be eligible for citizenship for three more years. Sorry if my question was not clearer.

So she didn't become a permanent resident just now. She became a permanent resident several years ago, when she got her 2-year card. She needs to have been a permanent resident for 3 years before she is eligible for naturalization (can apply up to 90 days before reaching 3 years). As to whether she has reached that point yet, there isn't enough information to tell.

Wait, something isn't adding up here. If she just obtained residency, how did she file for removal of conditions already? Did you mean to say she just received her 10-yr green card but not actually residency?

What is the "Resident Since" date on her GC (either the 2-yr one or the 10-yr one, it should be the same)?

Now I'm not clear on it either. The OP says they did the ROC but that she just got residency. The former suggests they have the 10-yr card (which the OP confirmed) but the latter says they're in the AOS process.

So seems like OP's wife got condional GC thru marriage initially and now got 10 yr after successful completion of ROC.

To OP: so if it has been 3 years since your wife got your conditional card, then yes she can apply for citizenship. Check the Resident since date on her GC. She can file for citizenship up to 90 days before her 3rd year GC anniversary.
