On the AOS, part 5 says "Do not count any member of your household more than once." Then #1 says put number you entered in Part 3, Item Number 28, which is 1, my husband. However, #3 says "If you are currently married, enter "1" for your spouse. If I put "1" in both places, I will be counting my husband twice. What should I do? I was thinking about putting an explanation on Part 11 about counting him once.

Secondly, on Part 6, #2 says "My current individual annual income is:" Do I add up my income for 2016 so far? Or do I list my AGI income from my 2015 taxes?

Finally, the instructions say to write "N/A" in any blank spaces that do not apply. The form doesn't allow a "/" to be typed in. Do I handwrite the N/A in the form?

Thank you for your help.

You put "1" in both places, but when you add them together in the household count, you only count him once. (If it's just you and him in your household, you put 2 for household size.)

Current income: This year's projected income.

For example: if you earn $500/week (and has been since the beginning of this year):

You put $500x52=$26,000 here. Nothing to do with your last tax return.

hi

you don't count a person twice,

that is in case you are filing for someone else than your husband, such as a parent, child or sibling, the parent, child or sibling would count on number 1 as the beneficiary, you on 2 as the petitioner sponsor and your spouse on 3 as part of your household size

that doesn't apply when the beneficiary is your spouse, your household size is 2 not 3, so your husband is counted on 1, you are 2 and the total sum is 2

current means the estimated amount of income that you will have this year,

I asked this question before and I received replies (thank you); however, I am having trouble with doing what was suggested. For the household size number on the AOS, I am the sponsor for my husband. So on part 5, it auto-populates a "1" for the number of people I am sponsoring. Later, it says to put a "1" if I am married, which I am. The question says to not count any person more than once, but when I type the "1" for husband, the form auto-populates my household size counting him twice. Should I hand write this portion instead of using my computer?

hi

no, you don't fill that one out because you are counting him twice

you would only put 1 for him as your spouse if you were filing for someone else, such as child, parent or sibling, then you would need to count your spouse for household size

but since he is the beneficiary, you already have counted him once on the form, if there is no one else, then your household size should be 2

Check the heading--it should say "Persons NOT sponsored in this affidavit." That means that you only put a "1" in the box for spouse if you're not sponsoring your spouse.

Specifically,

For the first box, "Provide the number you entered in Part 3., Item Number 28." you should put a "1" because you are sponsoring one person.

For the second box, "Yourself", you should have a "1".

And for for third box, "If you are currently married, enter "1" for your spouse." write "0". It's counterintuitive but correct.

Then the final count should be "2".

Thank you. I think I understand what you are saying. Maybe?

It appears that you are saying to put a "0" where it asks if I am married. Wouldn't the NVC wonder why I put a "0" for the question that asks if I am married when I am applying for a spouse visa?

I am using a home computer and the form I downloaded from online auto-populates the first and last questions which are: the number of people I am sponsoring (1) and the total household size (it puts 4, but the correct answer is 3). When it fills the "1" for the number of people I am sponsoring, then I type a "1" for me, "1" for my husband, and "1" for my son, the form fills in that my household size is 4. The form adds up the total for me and counts my husband twice because he is actually fitted in two places.

What is your opinion about keeping the "1's" in the four spaces, then whiting out the total and hand writing in the correct number (3). Or it is correct that you are saying to put a "0" where it asks if I am married?

I don't want to get a checklist because I filled out this part of the form incorrectly, but I really don't know what to do!

If you are sponsoring your husband, you really do put a zero in that box. If you read the directions carefully, it explains.

I promise it's correct to put a "0". We finished the affidavit a few months ago, and that's what we did. My husband just had his interview and the whole process has been moving along nicely.

You are right! It does say "Persons NOT sponsored in this affidavit."!!! It feels very strange to put "0" where it asks if I am married, but I am sponsoring my husband, so he does not count in that section because he IS being sponsored. Confusing...
