Hi,

I am US citizen and filed I - 130 for my spouse to come to States in May, 2016. Now soon as it gets approved and I send in papers for the sponsorship/support along with 3 year tax return. Can I go and stay with my spouse until they get visa to come to US ?

This means I will not be working in US for those months.

You do know that for a CR1 visa it takes about 1 year for approval.

Yes, I was reading once the I - 130 forms get approved in 5 months or less. Then I will be sending forms along with three year tax returns to prove I can support my spouse.

Since it's taking long time and I want to stay with my wife until she gets visa. Will me leaving to go stay with her in India mess up anything after I mail in the support forms along with the three year tax returns with my bank statements ?

Depends. Will you have a job to come back to? The same job?

My question is the same as above but I will go in further detail. What kind of job do you have that will just allow you to take upwards of 1 year off to stay with your spouse for immigration purposes, do you have enough expenses to cover that, also if you leave what kind of job will be awaiting you upon return?

I am IT contractor. I can find another project once I get back. But someone mentioned I have to have job at the time my spouse goes for interview ?

hi

you have to have a job, or assets to cover your wife until you can get a job, or a joint sponsor

taxes aren't enough, you have to prove to the government that when your wife comes, she won't become a public charge

If anything changes between sending the AOS and the visa issuance you must send a new one. If you will not be employed, then then you would need to have a joint sponsor or sponsor on assets alone. No I dont suggest going to India.

Yes, you will have to prove that you can support your wife here in the US. If you are not working during the process how will you prove this?

Future employment is not considered by immigration.

You will end up having to find a cosponsor, which could in itself be a lengthy and dificult process.

What is usually the process?

I 130 getting approved then sending in forms to prove that you can support the spouse and then they go for interview and Done ? It's what I understood from reading a lot of threads.

Also, on average how long it normally takes for the I 130 to get approved ? I know it says up to 5 months.

How long did it take them when you guys mailed in forms for the support ?

As previously mentioned, it takes a year.

hi

yes you can visit your wife for a short period of time without loosing your job

now if you want to stay longer, then as I stated before, you will need assets or a joint sponsor.

if you aren't currently employed without the mentioned above, your wife will be denied a visa, you have to prove to the government that your wife won't become a public charge

so you have to have income coming in, if you don't then you will need enough assets to not work or a joint sponsor to cover for your wife

I am trying to convince one of my relatives to co sponsor my spouse so I can go live with her now. Could anyone who been through that process please tell me what different I will need to do compared to me sponsoring her myself? What forms or formalities? Thanks in advance.

Anything you would have to submit (i-864, tax returns, pay stubs etc..) your joint sponsor would as well plus proof of their usc or lpr status.
