Hi everyone,

I got married with my current wife in March 2016. My prior wife died in Sept 2015 because of cancer. For my 2015 tax return, do I file married with my deceased wife or my current wife?

September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!

September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file

Hi everyone,

I got married with my current wife in March 2016. My prior wife died in Sept 2015 because of cancer. For my 2015 tax return, do I file married with my deceased wife or my current wife?

2015 taxes were due in April. Because you were married during 2015 you could file a joint tax return with your deceased wife. After her name, it would say deceased. You sign the return as usual and where her signature would go, you write "filing as surviving spouse". Her income is reported as what was received only until the date of her death. (If additional income for her was received after the date of her death, that is supposed to be reported on a estate return. A separate return in the name "the estate of Mary Smith" is often filed by the executor.)

Now to 2016. It doesn't end until Dec. 31. You are married in 2016 and can file a joint return (by next April) with the new Mrs.
