Dear all,

I apologize in advance if this questions have already been addressed regarding co-sponsorship for a K-1 visa.

The situation:

I have no tax records for the past 2 years, as it is required by the I-134 (Affidavit of support) form for the I-129F petition, however, I do have a current job which I started on 5/16/2016 (grossing just 10K above the HHS poverty guideline).

1) Will this affect my chance of my I-129F from being approved?

2) Would I need to have a co-sponsor to improve my chance? (Per other forums, I've read that consulate tends to deny application with a co-sponsor due to the fact that if the person is needing a co-sponsor, the person may not support his/her finance once in the country).

3) If yes to Question #2. Which form is used for the co-sponsor? (Would it be the same form? The I-134?)

Thank you in advance for your guide and expertise on this matter.

1) No. The I-134 is only evaluated at the embassy stage. USCIS won't even look at it and you are not required to submit it with the I-129F.

2) Policies on wether or not to accept cosponsors vary between embassies, please check your regional subforum or wait until someone else that has applied on Lagos shows up here.

3) In case Lagos accepts cosponsoring, both you and the cosponsor need to submit form I-134 with supporting evidence. The cosponsor must be able to qualify by him/herself, you can't combine your incomes, and you have to submit I-134 even if below the poverty level as you are the petitioner and that's expected from you.

Make sure to attach a statement explaining why you were not obliged to file tax returns for the years you didn't. And focus on proving current income using recent pay stubs and a letter from your employer.

I-134 is not sent with the I-129F. Please read the I-129F instructions and checklist from the USCIS site where you download the form.

The I-134 will be needed for the K-1 visa interview. You typically only need the most recent tax return and proof of current annual income, which can be letter from employer and recent pay stubs. You have not mailed the I-129F petition yet, so you should have a few months worth of pay stubs by the time you would have a K-1 visa interview.

Can someone answer my question in regards to this as well? :\ I've been stressing out. I asked it in my countries forum and on here.

I'm currently waiting for my NOA2. I just lost my job recently. I want to know what my options are from here on out.

- Do they just care about the fact that you're making OVER $22,000? Is it okay if I'm using two different jobs to make this much.. and is it okay I've been with one job for 2 months? Can they deny you even if you're making the adequate amount? Can an officer decide.. "Hey.. you're only 1,000$ over.. I don't feel comfortable with approving you."

-Do they look at debt to income ratio?

-Also.. is it accurate that all I need is pay stubs and an employee letter stating I'm in good standing?

Please help. :(

Is it okay if I'm using two different jobs to make this much Completely OK! .. and is it okay I've been with one job for 2 months?It's ok, but focus on providing enough documents to prove current income, such as pay stubs, letter from employer and maybe bank statements. Can they deny you even if you're making the adequate amount? Can an officer decide.. "Hey.. you're only 1,000$ over.. I don't feel comfortable with approving you." They can't/shouldn't and there are no recent reports here of people that have had it denied that way, but perhaps someone else will shed more light on this. As far as I know, they can't, as the legal criteria is 125% poverty guidelines and not a penny less.

-Do they look at debt to income ratio? They don't.

-Also.. is it accurate that all I need is pay stubs and an employee letter stating I'm in good standing? See the guide and FAQ here on VJ to get the other info the letter has to state. If you have other evidence of current income, you can use these too.

Please help. :(

One more question I am concern about if I choose not to use a cosigner.

What is the minimum amount of money does one need in the bank in terms of stability when sponsoring a finance?

There is no amount you need in the bank. Assets are not a requirement. Your current annual income is what is the most important key factor.

Has anyone used assets of their foreign fiance to satisfy the financial requirement? I'm working but don't make nearly enough for the minimum, but he has enough in savings to satisfy the amount needed.

Self sponsoring is possible through the London consulate. You should ask about it in the UK regional forum.

Question regards sponsorship.

I the US petioner doesnt have work yet in the US. I will just start to live there for good this June and I wanted to file a K1 visa after I buy a house and car there and settle for good, is it possible that I can file the k1 visa for my fiance in the philippines. My source of funds for buying a house and car are my grandparents here in the philippines..lets just say they are finally setting me free to venture on my own but then they will at least give me something to start with like the house and car that I will buying and a $6,000 allowance every month till I finally get a job. Please help me out if it wont be a problem if a file a K1 visa soon as I get the house and car when I get back ti the US this june.
