Today my fiancée had his K1 Visa interview at the embassy in New Delhi. This is the second go around.

The CO asked just a few questions did not ask for anything except my I134 and gave him a letter saying:

"Dear---- Please bear with us as your case undergoes necessary admin processing we will contact you when we are finished..." It said absolutely nothing about 221G processing

They did NOT keep his passport. Will they ask for it later if this gets approved ? Keep in mind USCIS will expire my petition 6/23/16. We have spend hundreds of dollars so far and absolutely no definitive answers or K1 visa approval

Has anyone experienced this and what does it mean?

I don't understand why they can't just say a simple yes or no. Why do the leave us hanging?

Sorry to hear that.Looks like the outcome will be the same like last time.I advised you to involve your congressman last time you posted about it.Did you ever contact them?I truly wish and hope that they issue a K1 Visa.

Seems you have been put on hold and are in administrative processing(AP). There is no definitive time frame for AP. It can be short or long.

Last time the letter clearly stated 221g administrative processing. This one did not. Yes. I contacted local congress sentate even had a letter of recommendation from my local assemblyman.

I wish someone would tell me why they will not grant my fiancée the k1 visa.

I am confused....according to your time line last year your K-1 visa was put under administrative processing and then while under AP you went ahead and applied for another k-1 visa??? Did they eventually denied the last k-1 visa or are you still under AP from the last k-1 visa???? Edited by MrsBurgz

K1 visa petitions have a four (4) month validity date. By USCIS. I was advised by USCIS to refile and submit a new fee when the last one expired while under AP

Same thing will happen now as this petition will expire 6/23/16. It's a game they play.

Is there no way for them to extend the expiration date? I'm not sure if there is, but i know of a few people that were in AP 6 or 7 months, then eventually get their visa. How did their expiration date not run out? A month is when yours expires, and honestly you should expect at least that from AP.

They do not play games...and your other app although its expiered they expiration date is for the interview. You need to let the process work...

I wrote to USCIS Today and forwarded a copy of the letter requesting to extend the expiration date. Will wait for their response next week. I'm hoping it's just additional background checks and they will call him to collect his passport.

I just want to know why they keep doing this. I have it in writing from USCIS to re apply and submit fee when it expired last time. Have no idea why some others have AP for 6-7 months and then get the visa. Each case is different I suppose.

Ok so according to this the expiration date is for the interview. So you need to slow down, and stop rushing things. How long were you in AP the last time? You should've waited it out before letting submitting a new I-129f. My fiancé lives in the Middle East and in my mind I'm hoping he's in AP a month or two, no longer. But I know that I have to accept the fact it could be months, so I have. We are all eager to be with our loved ones, but trying to rush the process has probably cost you more money, and time.

So I just re read last years letter and it is very differnt than the letter he got today. Last years said they were sending back to NVC , more of a denial , and this one does not say that...Now I'm really Thinking they are doing some additional background checks only and will ask for the passport. Staying hopeful

I did wait last time- and USCIS TOLD ME THE ONLY OPTION WAS TO RE FILE AND SUBMIT A NEW FEE WHICH I DID. AND HERE WE ARE AGAIN...

You guys I'm not sure what petition you are speaking of assuming you all have filed K1. i129f FIANCÉE. but K1 Visa petitions approved by USCIS have a four month validity period. several cases get put on AP and eventually expire. This is a known fact maybe you should be aware of so you are not in the same position. Maybe it's different for I130 spouse...

Lee- it was AP last time. At least that's what the status online said for 6 months after the interview and until Inwas told to refile.

I'm in fact doing the K1 visa, but I honestly don't know about the validity of the petition. Like I stated before, I do know people that have been in AP for several months, but I'm not sure how they had their date extended, or if it's something that is supposed to be done automatically.

The K1 petition expires after 4 months from the date of NOA2. Almost always the CO's extend it.The K1 expiry date doesn't matter much.Now,the CO's do not deny the visa unless they have solid proof of something.They send back your case to the NVC and tell you that they are working on it and they give you 180 days for a result but in majority of cases they let this 180 days pass and then tell you to apply again.Now you need to tell us what were the Red Flags in your case last time?
