Hi,

My fiance and I currently have a K1 petition pending. We have filed earliest last month, however previously I had been denied entry into the USA for lack of sufficient ties to my home country and it raised suspicion when I said I was visiting a "friend", but they gathered otherwise after looking at my phone (wasn't aware of my rights at the time). They had given me a form, stating next time you try to enter the USA you will need (the list of sufficient ties).

Now, while the K1 is being processed I would like to visit him in the USA for a week. There's a specific festival we're planning to attend and so it will be solely for this event. The list of documentation I am bringing is:

  • K1 NOA1 copy
  • lawyer emails (contract payment form and NOA1 email)
  • 3-month lease agreement (between roommate and I)
  • mail sent to my city address
  • contact information (where I'll be staying, contact info of fiance and friends, etc.)
  • social assistance documentation (recent welfare forms, etc.)
  • plane ticket receipt emails
  • recent account balance statements
  • appointment emails

I have recently gotten a part-time job, so I am hoping they can provide some documentation as well (letter w/ dates of when my next shift will be, etc.).

Do I have a solid case to be able to now visit for a week in the USA?
Also, we were thinking of flying to his home in the USA and leaving the USA to stay in Mexico for awhile - if I tell the POE I am visiting USA for a week and coming home, but goto Mexico instead (still right after that week has ended) would that be considered fraudulent/lie?

Are we better of booking a direct flight from Canada to Mexico and seeing each other there, instead of the potential of being denied entry into the USA again? And would that affect my eligibility of getting into Mexico the following week?

Your ties are pretty good, but the K1 process sometimes helps (shows you want to do things the legal way) and sometimes hinders (shows you want to immigrate), so entry is not a sure thing.

Always tell the truth. If you tell them you are going home, but they find out you are going to Mexico, they won't believe anything you say (such as that you are leaving at all). There is nothing wrong with travelling to a third country, the main thing is that you leave, so tell them the truth.

Being denied entry into the USA will not affect your entry into Mexico, it will just cost you money to change flights etc. Being denied entry a second time will also not affect the later K1 approval, as long as you do not lie during any secondary inspection.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
