how long does it take for AOS to be approved

hello,

i just want to ask some questions, i am here in the US, as K1, i arrived last april 2, 2016 and my visa will be expired this coming june 30, i got married last may 14, i plan to process my aos soon, probably this week, i read that i need to have my form 1-693, which will be signed by the civil surgeon. i had a medical exam prior arriving here, and upon arrival here in the us, the custom took the packet that was sent to me by the us embassy, together with the medical records i believe.

now my question is this.

1. is the form i693 similiar to what ive had during the medical? or should i undergone another medical here? and send it to them?

2. how long does it take for the aos to be approved? or for me to get an interview or green card?

3. what if its not yet approved and my visa is already expired? should i leave the us?

your help will be very much appreciated. thank you

2) I believe current processing time is around 9 months

3) NO definitely do not leave the country after you have filed for AOS. From what I understand this will be seen as you forgoing your application and you and your fiancee will have to start all over. Once you are married and sent in paperwork for AOS, you should remain in the country until you receive your conditional greencard

  • On Oct 13th AOS status was updated to say that a notice was returned due to post office being unable to deliver it. Tier two told me that it was biometrics or NOA1 (even though I had received both before this date).

  • A few weeks later I received a notice dated Nov 10th, in regards to my call about the Oct 13th notice. The new notice said that there were no RFE's or withholding on my case. So still not sure what this Oct 13th notice was about.

  • Received a letter from a NY office on Dec 23rd (dated Dec 10) stating that my medical was over 1 year old. (At this point my medical was only 7 months old)

  • Teir two submitted an internal service request to which I got a response telling me that I need to respond to RFE ASAP

  • Submitted another service request on 1/6/17. To which I got a response on 1/19/17 stating that my case was pending and is outside of processing time (no mention of RFE)

1. Form I-693 is a form from the hospital when you had medical exam for your K-1 visa. In my country, the embassy put it in the same envelope with the passport.

2. I'm not sure about the exact processing time for AOS, but mine was only taking 2.5 months.

3. As already answered above, do not leave the country until you get AP or green card.

1. You must file I-693 with your application. The USCIS instructions for I-485 says page 4 tells that ( https://www.uscis.gov/sites/default/files/files/form/i-485instr.pdf ), You do not need to submit the entire medical report but you need to submit the I-693 supplement. Read the instructions carefully.

2. I am not sure.

3. DO NOT leave untill you get your AP or AOS. I am not still sure what is the proof of legal presence though.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Going to clear up a few things...

The K-1 medical abroad was done by a panel physician for the Dept. of State. They use DS forms. There was no I-693 for the K-1 medical. The I-693 is a USCIS form used by civil surgeons within the US.

You do not have to include an I-693 supplement, as there is not really such a thing. It is either a properly filled out DS-3025, or see a civil surgeon for an I-693 in which they will fill out parts 1, 2, 4, and 7. 2) It depends on whether or not you have an interview, and if you do, how backlogged your local USCIS office is. See the AOS Progress Forum to see timelines of others.

3) If you leave the US before getting AP or your green card, then you will abandon your eligibility to AOS. You would then need to file for a spousal visa to re-enter the US. Your visa became invalid the moment you used it to enter the US, as the K-1 is a one time entry visa. You were given 90 days when entering, in which you needed to marry. Your I-94 is used to show your legal presence in the US once you enter. However, as soon as you apply for AOS and have your receipt notice/filing date, you are in a new period of authorized stay.

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

what do you mean its going to be waived? does it also mean that i have to file AP even if i dont have any plans to travel out of the USA?

Waived, as in you do not pay the filing fees for those forms when they are filed with a pending I-485, so they are free to file that way.

Even if you have no plans, you should still file the I-131. You never know what might come up, and there have been plenty of people that wished they had filed for AP to begin with once they discovered they needed it.

my experience is from filing to interview is about 3-4 months. do not leave the country until you receive your card. otherwise, your case will be considered abandoned. good luck.

1. If it has not been a yr since you had your medical from your home country for visa processing, you don't need to undergo a whole new medical in the US. Check your vaccine sheet, see if the box that says complete is checked, if not, USCIS may require you to have it evaluated to make sure you have the complete vaccines per CDC guideline. For now, you can file Adjustment of Status, send a copy of your vaccine record and wait until USCIS will require you to have the I-693 form, which if you have your vaccine sheet evaluated the civil surgeon will still give you that form.

2, AOS varies, it may take up to a yr, some faster, depends on how busy your local USCIS office

3. You just need to get married within 90 days of arrival. No need to leave the US, you just have to file AOS even your visa or I-94 expires.

2/24/16 - AOS, EAD, AP packet sent

2/29/16 - Received Date

3/03/16 - Received text and email notification

3/04/16 - Check cashed

3/07/16 - I-797 hardcopy received
